ITIN for Taxes!!! GRRRRRR....

We decided to file jointly back in February, and filled out our W-7 and with that sent in a copy of my wife's passport, which we had notarized in Canada. We had tried to get it notarized at the US Consulate in Nassau, Bahamas, while there on vacation, but they refused to do it.

Anyway, I just received a notice from the IRS that they are unable to proceed with our return because, apparently, Canada doesn't belong to the "Treaty of the Hague," whatever that means, and therefore the Canadian Notary is unnacceptable. So now we need to have Corinna's passport notarized by a US notary at a US Consulate (Toronto?) and sent to the IRS branch in Austin (within 45 days). Also, we need to send a marriage certificate, since her passport is in her maiden name, and that's not her legal name that the taxes are being filed under. I find this ironic, since the K-3 visa will be granted in her maiden name (seeing as that is the one in her CDN passport.) So one government agency specifically wants her to file under her married name, the other won't grant her a visa unless it's in her maiden name...God Bless the USA

Anyway...Has anyone else had to get something notarized for US government purposes in Canada? How did you do go about it?

It looks like Toronto has a walk-in service for notarials Mon-Fri 8:30am-12noon. Link. In this circumstance (Canadian requesting the service), and since she'd be travelling so far, I'd call ahead just to be sure, though. Toronto Consulate link.

I know you can make appointments online for Toronto, and that really expedited our son's CBA appointment. I was hoping there was a better way than having to drive to TO, but I guess we'll go to the Zoo and make a day out of it...

Im not sure this is the same prob but we sent the same documents twice...and we just got another denial letter (but no reason stated) it says on there if im reading right they will just remove them as a exemption and go on and process when i looked in the computer said mine now will be process on June 10. I am still getting my congresswoman to ck what is the problem etc and now since they take them off our returns will we qualify for the stimulus like i say mine was concerning Morocco but same general tax prob i think (and i have heard of MANY) not getting the numbers

I went into our local IRS office today and the lady told me if I can bring in my wife's passport and a marriage certificate, she would process it and we wouldn't have to send everything back to Austin, Texas. Maybe you should go and talk to your local office, if that is an option.

And I would imagine if they go ahead and process as filing single, the USC would then get the Economic Stimulus check.
