actually i have a quetion , i came to the states on a k3 visa , my second marriage anniversary is gonna be on september 11th ,,so now i got my Noa to my AOS on june 20th ,, if my AOS gets aproved after my marriage is 2 years old ,, am i gonna get a conditional GC or an unconditional one?? ,, thanks

Hello Saed, after i read your question, i went and i read the K3 flowchart and i find out that if you get a green card will be valid for 2 year so it is conditionally and you will need to apply for lift condition 90 days before your 2 yrs GC expire ... go here and find out K3 Flowchart

I am not sure if your point of view is right but i never read about that case before so i may be wrong, but i went again and i readthe FAQ for K3 visa and i copy out this main answers:

14.1)...How soon after we arrive in the U.S. should we apply for Adjustment of Status?

A..For most people, this will be "as soon as possible". The USCIS (INS) has made an assumption that nearly all K3/K4 folks will want to apply for AOS, even though a few will still choose to apply for an immigrant visa at a Consulate outside the United States.

14.8)...My status as K3 is about to expire, and I am still waiting approval of AOS. Is there anything I can do to keep my status?

A..Yes, you can apply for an extension of status with the USCIS (INS). This will enable you to leave the United States and return without needing Advance Parole. It is probably a good idea to extend the K3/K4 status if you plan on being outside the country.

As with renewal of EADs, your application for extension of status as K3/K4 will not be approved if you have never applied for Adjustment of Status, unless you show that your initial I-130 petition is still awaiting approval, or, if the I-130 was approved, that you have applied for an immigrant visa at a U.S. Consulate.

Yes it is. Considering last touch was the 17th which is after i got my NOA1s.

• If you mailed your application or petition more than 30 days ago to a Service Center or to our National Benefit Center, and have not yet received a receipt in the mail, call customer service for assistance.

• If you did not get any other kind of notice—and you have a receipt number, and case status on our website states that we sent you a notice (other than the receipt notice) more than 14 days ago, but you haven’t yet received it, call customer service.

It's not a problem how to check things.. what is concerning some of us is the timeline averages from NOA1 to Bio letter. Most seem to average a week max. None of us with an NOA1 date of the 13th have received our letter. I know how to check, I have it as a favorite but nothing and USCIS has nothing either. So a few of us i think are just a bit concerned atm.

I also took the from the K3 guide (process flow chart)

"If your interview (and specifically the approval) occurs within 2 years of your marriage you will be granted a conditional permanent residency (2 year validity). If this happens you will have to apply to lift conditions 90 days prior to your 2 year green card expiring. If you are 'adjusted' greater than 2 years after you were married you should receive a normal 10 year green card"

I am in a similar, but not identical position. I am married to a US citizen and came over here shortly after our marriage on an H1. I decided to wait until close to our two year anniversary before starting the AOS as I knew if it was approved after our two year anniversary, then I would get a 10-yr green card and have to deal one less time with USCIS.

thank u evreybody for our riplay , i m really so glad to join this forum ,anyway we r all in the same journey and i hope good luck to everybody ,,, there is an other thing that i dont understand ,, that there is some people who gets approved wihout having an interview , they just receive an email saying (aproval notice sent) ,, i had a friend who got his card mailed to him and they did not require him to have an interview... its just odd ,,,,,

16th here, received biometric notice today scheduled for 7/16.

That is why some of us are concerned. If someone past the 13th is getting their Bio letter.. did ours vanish in the abyss of USCIS?
