AOS I-134 / I-864 are they the same?

In Dec 07 I sent my complete I-130 package including the notorized I-134 AOS form including tax returns, and all financials. I just paid my AOS bill online and they did not instruct me to fill out the new I-864 forms so AI just sent in the barcode sheet. It says on the web site not to take any action unless instructed to do so as to not delay processing so I was afraid to just fill one out on my own. Do you think they will/have accepted the old form? Has this happened to any of you Dec fillers? also Hubby emailed his letter to choose me as his agent.....does he also have to fill out sign and mail a hard copy of that form as well?

They are NOT the same.

I-134 is only used for NON-Immigrant visas like K-Visas.

I-864 is used for GREEN-CARDS, that is for CR-1 and IR-1 Visas because they result in green-card upon entry, OR it is used for adjustment of status.

I see. Well does anyone know why they are not asking me to submit the I-864? The hard copy AOS bill stated not to submit the I-864 because it could delay my process. I looked at the I-864 and it is very simular to the I-134 accept it is not notorized. Do you think they will just use the info from my I-134? I want so bad to just fill out the I-864 and send it to them! But UGH!

I would call NVC about it, and have one prepared to be brought to the VISA interview.

The green-card REQUIRES that the US citizen spouse MUST sponsor the immigrant, and this requires I-864, a green-card cannot be issued without a sponsor.

This is correct, you need the I-864. But I am worried that taking it to the interview won't be the answer.

Unless Morocco has changed its procedures for the CR1 you would first receive a bill for the I-864 while your spouse receives the DS-3032. Your spouse will use this form to give someone, usually the USC, kind of like the power of attorney for the DS-230. In the meantime you are to send in the fee for the I-864. Once they have received and posted your payment they will send you the I-864. You fill it out and send it along with all of the other info it requests. Then after they receive your spouses response to the DS-3032 they will send you (assuming he assigned you the liability) the bill for the DS-230. Once they have received that payment and posted it they will send you the DS-230. Once it has been filled out you send it back to the NVC. They review to make sure that all of the papers are filled out properly and all forms are included. Then they schedule the appointment and forward the package to the consulate. If by chance you don't send in the I-864 they will certain request this before they go any further with the process.

Like YuAndDan said, call the NVC. Have your number ready and talk to a live person.

By chance, did you file the I-129f after you received the NOA1 for the I-130? If you are processing for the K-3 visa then this form would be correct.

I only files the straight I-130 spouse visa. The I-134 is the only AOS form I ever saw even here so thats why I used it. I paid our AOS fee online as soon as I got our NVC case and IIN numbers. I had my husband send an email stating he wants me as his representative. I still did not recieve a request for the I-864 from NVC so maybe they will do that soon even though I sent in the notorized I-134 in dec (accidently) It seems both forms require the same information be entered so it should be easy to resubmit but I will wait until they request it first. I will call them tonight.

From my experience, they ask you not to submit the I-864 until they tell you to do so (people finds ways to rush things). They take your fee payment first, THEN tell you to submit the next step.

Looks like you could use this.

Cool. Thanks "VW" cute name BTW. I think I won't worry about it, they will send me the I-864 when they want it. I just kept reading all these people here sending both things ASAP on theyre own.

They do, and that is why they tell you to wait. There are proceedures to follow, and too many people try to rush it, which slows down their system.
