HELLO TO ALL!!!

I HAVE A FRIEND THAT IS GOING TO GET MARRIED WITH A COLOMBIAN WOMAN. THEY BOTH LIVE IN FLORIDA. HE WAS TELLING ME THAT SHE HAS A WORK VISA AND THAT THIS VISA EXPIRES IN NOVEMBER. AS I UNDERSTOOD... SHE GOT TO FLORIDA ON A TOURIST VISA... AND APPLIED FOR A WORKING VISA AND STAYED...(I THINK).................

WELL ANYWAYS... IF HER VISA EXPIRES IN NOVEMBER AND THEY GET MARRIED BEFORE NOVEMBER... DOES SHE STILL HAVE TO RETURN TO COLOMBIA UNTIL THE I-130 IS APPROVED? DOES ANYONE KNOW HOW THIS WORKS? PLEASE PROVIDE INFORMATION ON THIS...

She came here legally, so she is ok. The only issue will be the overstay of her visa if she does not leave before it expires. As of now, once the I-130 is approved, she can adjust status in the US. If she overstays, she will have to file an I-601 for illegal presence in the US. It makes the case a little more difficult. I hope this helps a little

I am not an expert in that category, I am hoping that one of the more knowledgeable members will join in here. I would say she could try to extend the work visa, but I do not know how that works
