Hello There:

I am a Canadian married to a U.S citizen. We got married July 6, 2002 in Calamine, Arkansas. ( have the marriage license to prove it) I traveled back and forth from the United States to Canada every year during my husbands vacation time. I usually stayed behind and visited with family for 120 days, which is short of the 180 days allowed to be in the United States. Feb 2007 my father passed away, and of course I wanted to be North to be with my Mom, so North we went. You know the saying regarding hind-sight ? Well I know now that I should have stayed in Arkansas and did this immigration from there. Not only was I turned back at the port of entry (married to a U.S Citizen) they have my finger-prints and picture on file ( found out later that unless the customs officer is going to actually charge a person they have no right to finger-print or take a picture, so stand up for your self) Since March 2007 its been a very frustrating time. NVC for us, seems to take forever and sometimes I'm really not sure that even they know what's going on.

On Oct 30th, 2007 we sent them the I-129F paperwork, and on Nov 26, 2007 it was refused. The I-129F did not apply to me, cause I am married to a U.S Citizen and am applying for permanant residence status, not temporary residence status.

The I-864 was mailed March 25th ( no status report) Fee bill for the G-628 was asked for April 23, 2008, mailed to NCV May 7, 2008 but not the forms.

Not to discourage anyone who may read this, but do an internet search. If you think this process is only going to take 6 months espically if you trying to go for permanant residence status guess again. Two and possibly Three years is the time. Its been thirteen months for me, so far and I'm still no where near the medical exam.

Hubby is in Arkansas, tending as best as he can to our six horses, two dogs, working full-time, and wanting me home, as much as I want to be there with him. In the thirteen months of this forced seperation I have seen him for seven days. I miss him daily, and long to be where I belong, not where I am forced to be. I love Canada, but its not home to me.

First of all.. The I-129F does apply to you... The I-129F is a dual purpose form.. It is the petition to determine the eligibility for a K-1 (Visa for Alien Fiance(e) or K-3 (Visa for Alien Spouse) both of which the intention is to become a permanent resident (via the eventual filing of an I-485 after entry in the USA).

Yes we sent the I-130 first. It was approved in August 2007, with our case-load number. The K-3 visa we were told by NVC doesn't pertain to our case, cause that is for Temporary Residence status, and we are going for Permanant Residence Status. The I-864 has been sent to NVC just no word on its being processed.. Fee for the G-628 forms has been sent.

well that's why they didn't accept the I129f because your I130 was already approved before you sent it. So that makes sense. K-3 people usually send their I129f after they get a NOA1 for the I130.

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.
