I talked to the security guard at the social security office (didn't want to wait on line to ask one question, there were tons of people there), and she said Tik has to bring her passport and green card to get a social security number. Well of course she can't get a green card until after AOS, after we're married, which requires a social security number from what I understand.

So questions:

1. Do you need a SS# to get a marriage license? Any New York specific information would be great, but if you're from somewhere else please help too.

2. On the application she gave me it says if you're not a US citizen you must bring "US immigration document and foreign passport." Is a K-1 visa in the passport counted as the US immigration document?

In Missouri, we took his passport with the K-1 visa in it and his birth certificate and applied for our marriage license. They wrote his visa number in any relavent spots on the form. No issues. It happens all the time.

hi we're from North Carolina.

when we got married, we did not need SSN, I just signed affidavit that i don't have ssn yet..

I just brought my passport/K1 visa with the attached 1-94...

Then fee $5O, here they only accept cash.. (i don't know in NYC) maybe they have their info in their website..

after marriage I applied for SSN Card,,

I brought my Marriage certificate (original) coz i used my married name..

You do not need a green card to get a social security number, SSN. (If you get one before you get the greencard, you will have to go in and have them change your immigration status...its very easy). There is a section on K1 getting SSN in the VJ guides section.

Q1

Call the office where you will apply for your marriage license. The SSN requirement can usually be waived, I don't know about NY specifically. In Louisiana, they say that a SSN and 72 hr wait period is required on the website. But when I called and explained my situation they said those requirements could be waived. The day we got our license, we had to have a the requirements waived by a judge. It didn't cost anything extra and it took literally less than 10 minutes.

Yes, The US immigration document they are probably talking about is the I-94, which is stapled inside the passport. I think the K1 visa will also count.

You certainly can but be prepared for a whole new set of "battles" when the SSA cannot match your wife's application (ie..married) name with her DHS/USCIS "name".

As often as the actual clerks at the SSA don't understand the rules governing issuance of a SSN to a K1, I would think that getting advice from the security guard would be even less reliable. The truth is that the security guard was wrong and does not know what he's talking about. You can get a SSN issued based on a K1 entry as long as there are at least 2 weeks left on the I-94. Take your passport with the K1 visa and the I-94 and get the SSN.

We got Marlene's SSN after marriage in her married name. They can match the name in the SAVE system with the maiden name or "other names used".

It is not suppose to be, but many people have had issues.... BTW, DHS is not the one who has the "heartburn" or "beef" in this... It is SSA who should be able to match up the name, but sometimes can't or doesn't want to ... or more likely that it is that they do not understand there own procedure...
