Affidavit of Support for K-1

Hello fellow VJers. . . .

My fiance is preparing I-134 because I insisted it is the one required by the USEM. However, our lawyer sent him forms on I-864 because according to her "the National Visa Center and most of the Embassies do not use the I-134 any longer, but require the I-864, affidavit of support to be submitted."

Which is which? :help:

March 25, 2014 - Received/Priority Date

March 26, 2014 - Check cashed

March 27, 2014 - Notice Date

April 2, 2014 - Notice for Biometrics Appointment thru email

Aprill 22, 2014 - Biometrics

April 24, 2014 - In line for interview

August 25, 2014-Scheduled for Interview

September 30, 2014 - Interview and Oath-Taking :joy:

The instructions from the Manila embassy are to bring I-134 for your interview.

Unless things have changed in the last couple days the I-134 is still required for K1s. I-864 are required when adjusting status later in the US.

Have him do both!!! I-134 has to be notarized. I-864 doesn't!

I-134 = for K1 applicants

I-846 = for AOS applicants

Did your lawyer use I-134 when he filed your I-129 ? If yes, then its the same I-134 ( although a recent one is preferred) should be brought during the interview.

Mike and Mely is right, the USEM requires I-134 for the interview. . maybe you can ask your lawyer to read the USEM website so he is more informed of the documents required during the interview.

Once your petition is already in the USEM , the USCIS and NVC no longer have jurisdiction over the petition. It is now the USEM who will decide whether to grant the K1 visa application or not.

It is the USCIS who will approve the K1 petition filed by the petitioner. The NVC's responsibility is to record the approved petition in their system and give the Manila Case Number and send the same to the US consulate where the beneficiary is. The Filipina beneficiary applies for a K1 visa thru the DS forms and the USEM decides whether to grant it or not.

You are right so better tell your fiance to follow what the USEM says about what documents to bring. I-134 not I-846

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.

like the others, last I heard Manila was still using the I-134 for K Visas. you can double check the packet on the Embassy website. this will not be the first time a lawyer has given misinformation. :whistle:

My fiance is now preparing both I-134 and I-864.

This is not the first time that the our lawyer and I have disagreements regarding this process and I am deeply grateful that VJ Family is here . . . helping one another. :)

I-864 is what CR1/IR1 uses. For K1s, use I-134
