i have a question for you, hope you can help me.My girlfriend came to america, she is from the ukraine..she came over here on a j1 visa, (exchange student visa) it was good for 12 months, she is no longer in that program anymore, we are married now, and we want to change the status of her visa.. i am not really sure what step to take after marriage..any info would help...she is currently in usa and want to change status without leaving america. i am thinking since she is out of the exchange student program that her visa is closed status now.

THe J-1 visa may have a stipulation attached to it.. this is known as the Home Residency Rule. If she has the 2-year HRR requirement attached to her J-1, you will not be able to adjust her status until you either granted a waiver or she fulfills the requirement.

You should speak with an attorney to see if there are any stipulations associated with your visa before you continue. You do not have to have them file the forms for you, but a consultation is definitely in order.

I guess the main concern beside the home residency requirement is whether or not the J-1 holder has been out of status or not (prior marriage).

I would consider consulting an attorney.
