I find it hard to believe she does 1700 K visas a year. at $500 a pop, she would be one rich lady,lol

Yeah, the $500 is for the 'premium package' that we got... she hasn't helped at all, wish id saved the money for the wedding and moving.

K1 Timeline

March 2006- Met on my Spring Break, started emailing/calling each other daily.

June 2006-Started dating.

December 2007- Started getting papers ready for K-1.

December 23rd, 2007-- OFFICIALLY ENGAGED!!

Late December- Mailed all of paperwork off to lawyer.

January 1st, 2008- Attorney mailed off first package.

January 16, 2008- Received package back because check was from Canadian account.

Mailed correct check immediately.

January 29th, 2008- CSC received package.

February 8th, 2008- Received our NAO1

June 5th, 2008- Received our NAO2 via email!!! yay

August 27th, 2008- Interview- APPROVED!!

October 11th, 2008- POE Blaine: Moving for GOOD!!!

AOS Timeline

November 3rd, 2008- AOS Packet received in Chicago

November 12th, 2008- Check cashed!

back before they made appt, my wife waited out ALL day to talk to a government immigration, and he wasn't very helpful. More or less told her it was impossible to do on your own, and ya better get a lawyer,wrong!! We had a good lawyer, she did her job, but $$$$$ In a straight forward case, they truly do not do much! You still have to get all the documents (birth cert, police record, etc) and pretty much fill in the paperwork, they are $$$ proof readers. Oh well,live and learn!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

That's funny (well, not ha-ha funny). We had a Customs officer in TO tell us we had to get a lawyer when all this began, but on my numerous trips thru Pearson since, the majority of them tell me that lawyers aren't needed. I guess it all depends on who you talk to, and how helpful (relative word, that) they are...

Our lawyer actually hindered our case. We'd be together by now if it weren't for that a**-clown.

8/13/2007 - Son Drayson born in Sudbury, Ontario.

9/6/2007 - I-129F NO1

10/15/2007 - Trip to Toronto for Dray's Consular Birth Abroad, SS application, and US passport

3/18/2008 - NOA2 for both I-129 and I-130!! No touches or email notifications at all!

4/2/2008 - estimated that NVC received

4/9/2008 - estimated that K-3 was sent from NVC to USEMontreal

4/16/2008 - Received hardcopy from NVC

4/16/2008 - Packet 3 Received

4/24/2008 - Packet 3 Sent to USEMontreal

7/14/2008 Interview in Montreal!!!!

7/17/2008 Visa received

7/18/2008 POE Sault Ste Marie Michigan

8/21/2008 moving day...back to Anchorage, Alaska!

4/20/2009 AOS granted, 10 year Green Card arrives, Social Security # given :)

Your lawyer seems to be under the impression that you have a choice about what consulate to use. You have the same amount of 'choice' for the Consulate as she had to submit your I-129f petition! She had no choice - it had to go to California. Just like you do not have a choice of Consulate unless you provide them with a valid mailing address or reason for using the other Consulate - the decision of where to sent the approved petition is based on the mailing address you put on your application. Now, since she is so convinced that Montreal is the right Consulate, why not ask her to cover the costs of your transportation from Vancouver to your interview? She can obviously afford it and seems to think it is no big deal to travel all the way across the country when there is no need!

I really hope that she does not know what she is talking about... I think she is trying to scare me.

Well I have just read this thread, you know Michelle, you might just be saving yourself a lot of hassle by getting rid of this lawyer, even though you have already paid her and probably have no chance of her refunding your money!

What she has stated is completely untrue, not only should an 'immigration attorney' (and I use the term lightly) know this - anyone who has done 1 visa with USCIS recently would know this. In looking at her webpage, in the FAQ's she states this, for instance:

Q: Do I have to marry my fiancee once they come to the United States, may I bring multiple fiancée's to the United States, or may I bring the same fiancee to the United States multiple times?

A: No you are not required to marry your fiancee once they come to the United States. A fiancee Visa merely gives you permission to marry should you so desire. If you decide not to marry your fiancee the only requirement is that they must leave the United States before the Visa expires. Also, you are permitted to receive multiple fiancee Visa's (until you decide to get married), and you are also permitted to bring the same fiancee to the United States multiple times, so what are you waiting for?.

Even that statement alone is hogwash. Well it's true in a way, you can petition a fiance(e) multiple times or many fiance(e)s - but she states this as if it is a cake walk - apparently she hasn't read the 'up to date' instructions for the I-129F (page 2) - a waiver can hold up your application for years potentially. Also, each time, a new application would have to be filed, she makes it sound like the fiancee comes to visit for 90 days, decides not to get married and then USCIS will just issue another visa while the couple waits to decide to get married.

I-129F instructions:

2. Filing Limitations on K Nonimmigrant Petitioners.

If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

The only reason I point this out is just to reaffirm what everyone else has said, she doesn't know what she is talking about.

If you do decide to proceed with her doing your application, I would certainly make sure that you double check every single thing she does. Good luck for a speedy application approval and interview anyway :thumbs:

Thanks everyone! I am so happy to have found a place like this where I can ask questions and confirm my beliefs.

We have already paid her... so it would only slow us down to fire her. I'm just going to make sure that our petition makes it to Vancouver... and we'll be fine :thumbs:

Even though she is clueless, the only real damage she will do is make ur pocket book lighter!!! Just keep an eye that she is doing things properly and at a good pace. Is she an actual lawyer??

Yes, she is an actual lawyer... kinda sad. I'm not too worried, I don't really think she can mess anything up, I just have to make sure to get it to the correct consulate.
