Applying for tourist or visitor visa while I-130 is pending

Hello. I have applied for I-130 for my wife who is in India. Can she apply for tourist or visitor visa while I-130 is pending? What proof does she need to let the embassy know she will go back to India. What are the chances of the visa getting denied or approved? Thanks

I applied for a tourist visa when my I-130 was pending. I got approved right away. As long as you can convince them that you're not gonna overstay your visit. I had an employment letter with me, saying that I was going to be on leave for a specific date to visit the US. I showed my pay slip and then I was done.

As long as she can prove her ties back to her home country then she should have no problem.

I did when my I-130petition was pending, Consular in Hungary rejected it ,eventhogh I already submited my pay slip, Guarantee from my boss the I will be back and employment leter, bank account etc to prove that I will be back .:crying:

But you can try , may be you have luck .

Case complate : August 27th 2008 , Interview date will on Oct 29th 2008

Package forwarded to Local embassy : Sept 11th 2008

Package received : Sept 15th 2008

Receive interview mail : Sept 30, 2008

Medical check : Oct 1st 2008 passed

Vaccination : Oct 1st 2008 , OK got 2 shots

New Interview date : Oct 21st 2008 VISA APPROVED AND ISSUED

POE at Phoenix : NOV 28th smooth

Receive Welcome letter and SSN : Dec 17th 2008

Green card received : Dec 22th 2008

Well then, I guess it really depends on the officers and the embassy you are dealing with. Mind you that even if they approve your tourist visa, at the POE there is still a possibility that the officers there will deny you entry.

Doesn't hurt to try I guess? Just make sure you are fully prepared and manage your expectations. Good luck! :thumbs:

My husband applied in Costa Rica for a tourist visa and was approved while our case was pending.

We had all kind of evidence:Apartment, bank accounts, job,car ,medical insurance and a valid reason for his trip. They gave him a Single Entry visa for two weeks. once he arrived in Puerto Rico they approved a six month stay.

So give it your best shot...

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. I guess it all depends on the country one is applying from. I have read on a thread where the wife from Bangladesh was denied visa and know another who had the I-130 pending and was rejected twice. Guess it all comes down to how one can convince the CO at the interview. Maybe you can ask your spouse to call the US embassy/consulate in India and check. No harm in trying.

you know this is the inconsistancies that peeves me the hail off.... we were told by USCIS point blank tourist visa for spouse are VERBOTEN. That's nazi lingo for NOT PERMITTED.

I wonder if we should waste money on another try for that.
