Question for my MENA'ers

OK, I am sure there is NOTHING that can be done but I'm gonna ask anyway.

We have a friend who came on a K-3 visa. His wife went nuts on him and he left last year in January, I think.

He had a stamp "I-94" in his passport and a couple of lawyers told him that divorced or not, he could stay the full length of his visa without breaking any laws. His stay will be up in mid-June but we're wondering if there is ANYTHING he can do to stay.

If he gets married, can he file from here and just call it good?

Is it too late to file for "stupid wife went nuts on me and divorced me and then 1 month later married an egyptian only days after our divorce was final"?

If he does file for afore mentioned thing... what would he need as proof and what else might be required?.. seriously, the girl went mental, took all his money, didn't let him buy cigarettes....it was insane!!!

Do u think he will get a 10 yr ban coz he didn't leave within 30 days of the divorce even tho the lawyer said the I-94 allowed him to stay the full time?

I'm fairly sure he will be fine and if he gets married, they can just file for CR-1 and proceed forth ... after he goes back to his home country, that is....

First, in this case I would not be encouraging him to go home because Id be afraid he couldn t get back in . Look at these aps. I doubt he d get approved again. Second. I think he needs a good immigration lawyer because I think he could actually pull off refiling and NOT leaving. He arrived on a k3. Thats alot different than a k1.

His wife really needs a lawyer for him and I dont think he should leave the country. If it was like France yeah. But I dont think he could easily come back, proof or no proof. He really really really really needs an attorney and I think he will be fine.

Wow sorry to hear this, sounds like someone I know, hope he does't have to leave, and can find someone who will love and care for him and enjoy his life now in America. :thumbs:

i have posted there (thanks charles) I hope I remember to check in there for replies... Usually other forums are of no help (at least within the time frame I need the help in) so that is why I opt to post in MENA instead. We'll see if the other forum will help too... UNTIL THEN.. more advice greatly appreciated :)

Why didn't his lawyer tell him to adjust status at that time? I am no expert, but from what I have heard is that as long as he entered the US with the right intentions, aka a valid marriage, he can stay. What an odd woman his ex is.

I agree.. good attorney and once he leaves no promises he'll ever make it back... harder to get people out of the U.S. than in you know???

He entered on a K visa.....he can only adjust status based upon marriage to the original petitioner.

New wife???...need to leave the US before the I-94 expires and start all over again.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Perhaps I misunderstood, but I thought she stated that they did marry.

As for the new wife, yeah I have to agree. To marry just to stay is as illegal as to marry to come here.

Like DF said, K3 has to adjust with the original petitioner. If he stays past mid-June he will be out of status. Did he find someone to marry before mid June???? It would be a HUGE risk for them. HUGE.

Well as of a few months ago, this person did not have someone to marry, thus ..the question. I know this guy and concerned about him. He knows he has to go back or be out of status. I wasn't being flippant about it.

I'm sorry (not) but if he was trying to "find" someone to marry so that he could stay, shame on him and shame on anyone assisting in that behavior. :angry:

Don't just open your mouth and prove yourself a fool....put it in writing.
