thinking of going CR-1 instead of K3

Timeline

Ok so I sent in my I130 packet and included a cover letter stating that i will be sending the i129f upon reciept of the I 130. Is this going to pose a problem for me?

Could be! CSC may not send the I-130 to the NVC. Submit the I-129F for backup until you find out if the approved I-130 is sent to NVC.

Doesn't cost anything and you can still pick which visa you want later.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

May be you can call to ask them to ignore the mention of I-129F on the cover letter once you received the NOA1, and see how it goes from there? My husband did a mistake on the I-130, called to inform and received an email acknowledged the error and we were told the mistake will be taken care of when they case gets adjudicated.

08/15 Picked up packet 4 & medical check up

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

No worries. All approved I-130 will be forwarded to NVC for further processing. My husband mentioned on the cover letter that the I-130 was submitted for K3 visa (we changed our mind and do a IR1/CR1 instead) and our I-130 has been approved and has been forwarded to NVC.

omg thank you all sooooo much!!! Guess what??? I just checked the mail and I just recieved my NOA1....yes!!!recieved May 16, 2008 Yay!! I am so happy because before I got brave enough to file the papers alone I decided to go with a lawyer. March of 2007 the lawyer filed an I129F without filling an I130 and sent along with the I129F pictures of my wedding and our marriage certificate. Needless to say the case was regected due to a filling error.

Now i'm starting over again and I feel good about it this time. Just hope Im making the right decision to go for the cr-1 and not the k3.

K3 [nonimmigrant] and CR-1 [immigrant] are completely separate visas.

You are basically applying for 2 visas.

Only connection is you need the I-797 [NOA1] for the I-130 to file the I-129F [K3] and need the I-130 approval to adjust status for the K3 if you should choose the K3.

CSC was holding approved I-130 in the past if they knew you were going with the I-129F.

Hopefully that has changed.

VSC doesn't seem to be doing so.

You are not making a mistake going with the CR-1!

I did and went with the K3/K4 instead.

Still kicking myself in the butte for doing so.

yep got all of that too. I have copies of everything but the NOA1 but I have it so i will copy it.
