Divorce Decree

Hi Vj Members,

I dunno if it will be a major problem or not, as i was reviewing all my docs for my upcoming IV on may 28th... i noticed that my fiance sent me the uncorrected final page of divorce decree. He actually sent all docs i needed for about a month already, well both our fault actually cause we did not check thoroughly. Its holiday today so fed ex/dhl and ups are closed and my IV will be 2 days to go.

The problem is, the judge who signed the decree wrote a wrong year on it instead of december 18,2007 he put december 18,2008 so he had it corrected already (judge sucks!). The judge gave him another copy of that last page with seal and signed January 3,2008 and put a note nunc pro tunc 12/18/2007 (lawyer term which means order can be used only to correct obvious errors to make an order conform to the judge's original intent - as per google).

My problem is what if consul asked for corrected decree, i have original but date is not corrected. The consul can check also the decree from I-129f which i know they will have cause USCIS forwarded all our docs in USEM, which i have also a copy cause our lawyer sent me that. Can't reach our lawyer cause sunday there and monday is holiday too..

I have talked to some friends who are done IV and consul did not look for their fiance's decree.

I need some advices... I asked my fiance to write a letter with his signature that explaining the mixing up, he can scan and email me or maybe fax, so i can show to consul if in case they ask me about that. He can still send me that 1 page thru fed ex but will not be on time for my IV on may 28............. :crying: what is the best thing to do???? waaahhhhhh

10/02/08 - received and signed by V. Bustamante

10/06/08 - check cashed out

10/07/08 - date of NOA

10/08/08 - last touch for AP and EAD

10/28/08 - AOS transferred to CSC

11/04/08 - touched on AOS

11/05/08 - touched again on AOS

11/06/08 - touched again on AOS ( no touch on AP and EAD)

12/08/08 - EAD approved according to USCIS officer (from infopass)

12/09/08 - touched on AP and EAD

12/10/08 - AP approved dated 12/09

12/15/08 - AP on mail

01/12/09 - went to infopass - found out my EAD has been approved since DEC 8,2008

01/21/09 - biometrics appoinment

01/21/09- Card production ordered for I-765 and a touched for I-485

01/22/09 - touched on I-485

01/23/09 - touched again on i-485

01/26/09- touched again on I-485 and i-765! WOW!

01/29/09 - i-765 approval notice sent.. and EAD card received in mail

02/24/09 - AOS APPROVED!! thanks God!

02/25/09 - AOS touched again

02/27/09 - GC and welcome letter received in the mail

There's nothing you can do until after the interview now anyway. I suspect the CO won't be concerned about a divorce decree because the USC's eligibility to marry has been ruled on by USCIS already. The Consulate is more concerned about the beneficiary and relationship bona fides.

Facts are cheap...knowing how to use them is precious...

Have him fax or scan it. At least you will have something!

Thanks a lot... yeah i already paid doc verification last April 22 and was forwarded to NSO last May 5.. I have original divorce decree just that wrong year, i have a copy of corrected one but it is just a copy attached in I-129F which the our lawyer sent me.. Thats the one he used in USCIS application. Yeah i hope consul will not focus on that wrong date cause is already approved by USCIS.. I still hope everything will be fine. Pls. include me also in your prayers, my big day is coming on may 28th..
