I have the K3 and K4 experience but not with the mother and child in separate countries. I don't think a K4 will work that way but if it does, Manila needs your case file, which is not yet available because it's in Vancouver. Your son may be better off coming on a CR2 visa via his I-130. What is the status of the son's I-130 at this time?

I cant bring my son here in Canada for interview due to the fact that my son has no passport, I called Canadian embassy manila about tourist visa for my son just to come for US interview, but it will take 2 months to process and i don't know what to do..

I am not sure what to do if i should transfer my interview in manila but we got married here in Vancouver..

Well, your son is going to need a passport and probably documented permission from his father before he gets any visa anyway. Why don't you have those for him already?

Thanks for the reply:

i am working here in Canada/currently leaving here for 3 years. I got married last sept/07 here in Vancouver and i didn't had a chance to go back home due to my permit here. I am not married to the father , and i am not sure if need his permission because for 10 years he did not give any cents or any support or any Hi or Hello for my son .

I want to know if (for example ) i get my K3 visa here in Canada and get the passport for my son, do I need his father permission before I or my husband file for k4?

thanks

Well, you've already filed for both CR2 and K4 for your son but Manila doesn't have a case file for him. I believe if you never married the father, the PI considers you have full custody and there will be no need for permission. Check with a PI Consulate in Canada about getting your son a passport. It might be easier to do it in the PI with the assistance of a family member. You are months past when you needed to deal with these issues.

Again, what is the status of your son's I-130? Is it at NVC?

In general the K4 would be faster but your case file can't start on its way to Manila until sometime after you enter the US on the K3. Your son's I-130 can continue through NVC and probably get to Manila far in advance of your I-129F case file. That's why I recommended you pursue the CR2 for your son instead of the K4.

Now that you say you have to go to Manila anyway, my recommendation is even more firm.

You already have a thread on this. It is not "off topic". It is also no about adjusting status, where it's being discussed now.
