File for AOS before I-94 Expires?

Do you have to file for AOS before the 90 days on the fiance Visa expire or just Prove you were married within the 90 days you get with the K1 visa?

Any help would be great. We Just got married last week and have until the 16th for the 90 days to be over.

I think the most important thing is to get married within the 90 days before the I-94 expires. If you file for AOS a little after the 90 days, it shouldn't cause any problems.

K1 Visa Saga

7/27/2005 Went to India to see Sowmya

7/31/2005 Proposed and she said "yes"!

08/05/2005 Held official engagement ceremony

08/07/2005 Returned to US

08/26/2005 Sent in I-129F petition

08/31/2005 Received online NOA1

09/02/2005 Received NOA1 through snail mail

11/22/2005 Received online NOA2!!! (Day 88)

11/26/2005 Received NOA2 through snail mail.

11/28/2005 NVC receives case

12/1/2005 Case sent to Chennai consulate via DHL

1/12/2006 Interview date - Visa approved!!!

1/16/2006 Received visa by courier

1/20/2006 Arrival in US - Chicago O'hare POE (Reunited at last!!!)

1/21/2006 Returned home to Birmingham together.

5/3/2006 AOS application transferred to CSC

5/5/2006 EAD touched

5/8/2006 AOS application received by CSC

5/9/2006 EAD approved!!!

5/10/2006 AOS touched

5/13/2006 EAD card received

6/6/2006 AOS approved without interview!!!

6/9/2006 Received Welcome Letter

6/29/2006 Green Card received!!!

2/30/2008 - File to lift conditions on Green Card

Ideally you'd try and file for AOS before your I-94 expires. However, in reality there have been several VJ members who for varying reasons have been unable to file within 90 days of entry. Some have even waited 2 or 3 months after the I-94 expired and still had no problems filing.

The thing to remember is that every day after your I-94 expires before you file for AOS is considered a day 'out of status'. Once you reach a certain number of days 'out of status' it could have serious implications for your AOS application and future residency etc..

As long as you don't leave it for months and months and months i'm sure you'll be fine.

Timeline Summary

11/30/2007 - I-751 Mailed to Nebraska

12/28/2007 - NOA Received (application has been forwarded to California)

01/09/2008 - Biometrics taken in St. Louis

03/27/2008 - I-751 Approved, 10 Yr Greencard in the mail !!

12/20/2016 - N-400 mailed to Phoenix lockbox

01/17/2017 - NOA Received

01/25/2017 - Attended biometrics in St. Louis

09/29/2017 - Received I-797C notice dated 09/27/17.  Interview Scheduled for November 6th @ 8am

11/06/2017 - N400 interview in St. Louis.  Approved !!:jest:

02/05/2018 - Notice of Oath Ceremony date received.  March 1st, 2018 @ 8.30am
