GRETTINGS ALL AFFRIC VJ MEMBERS, I WANT TO APPRECIATE ALL VALUABLE CONTRIBUTIONS

I WANT SOMEONE OUT THERE TO CLEAR ME ON THIS ISSUE OF LAGOS NOT ACCETING

CO-SPONSOR FOR K1 VISA INTERVIEW.

I WANT TO KNOW WHETHER THIS IS A LAW FROM THE USCIS OR IS THAT MADE BY THE

U.S CONSULATE LAGOS?

MY USC FIANCE PRESENTLY IS WITHOUT JOB,BUT HAVE BEEN WORKING FOR THE PAST 4 YEARS PLUS

ON AN ANNUAL PAY OF 25K PLUS FOR HER ALONE,NO DEPENDENT.HER 3 YERAS TAX SHOW THAT.

SHE RECIEVED PAY FROM THAT FIRM TILL FEB 2006,BUT MARCH,APRIL WITHOUT PAY.

WILL IBE FINE WITH HER PAST INCOME RECORD OR CAN THE MUM STANDS FOR HER AS CO-SPONSOR?

PLESE I NEED SOMEONE WITH FACTS TO RESPONSE TO THIS QUESTION.

I WANT TO APPRECIATE ANY VALUABALE CONTRIBUTION.

It is not a law, but the USCIS and the Department of State agrees that a consulate does not have to accept co-sponsors for a k visa. The consulate also has responded to one of my senator stating that k visas do not allow you to have a co-sponsor. Fortunately for many others, other consulates in other countries the embassy allows them to have co-sponsor but it is the embassy's decision. before, lagos used to allow co-sponsors but they are not doing it anymore.

I think at this point you should just go with what you have- letter from the new employee and co-sponsor stuff and see what happens.

08/08/05 Hubby picks up interview packet from embassy

11/17/05 K-3 interview (denied, C.O refused to take co-sponsor for k-3)

12/16/05 I-130 NOA2

01/03/06 NVC assigns case number

02/15/06 Case complete (thank you James Shortcuts- only 6 weeks!)

04/19/06 tired of waiting, filed k-3 #2 ( petition is still lost in oblivion)

09/11/06 NVC scheduled CR-1 interview/ on to Lagos (thank God after 7 months of waiting!)

10/14/06 Interview date (success!)

10/18/06 Hubby goes to pick up visa- not ready ( ugh what's going on!)

10/19/06 Visa in hand ( thank you God!)

10/29/06 Together at last :)

omg.. that's evil of those consulates.

Algerian consulate says that the affadavit support isn't required, but it has to be furnished on request. It's fine if you need a co-sponsor

Yes, there have been many couples woh have gone through the Lagos consulate that have been turned down because of co-sponsers for k-1s and k-3s. Basically, Lagos wants to deny any one they can and so they try anything. So far, they have been allowed to deny co-sponsership. There have been a few who have gotten through, but only a small few and those seem to be a while ago. Good luck.

Yes, like S&S said, it is purely up up to the discretion of the Consulate as to if they will accept co-sponsorship or not on K visas.

Well this is just a thought. I replied to your last post, but was thinking that maybe you could have the co sponser papers ready as a back up plan. In case they deny you based on your fiance not being employed presently. I know your interview is coming soon, but is it possible for your fiance to take a smaller job just to qualify untill the other job kicks in?

It sounds like you are saying that the USC is currently unemployed. I would try not to present this information outright because it will not be treated positively. Instead when they ask for the financial info you should present tax information for the past 3 years. If she made 25K you are over the limit, but they will also want proof that the USC is currently employed. e.g. a letter or paystub. I don't know what you can do to get around that. Take the evidence that she still had the job in Feb.

Lagos is not likely to take any co-sponsorship for K1 but you should take the information just in case.
