Hello everyone! I`m new on here. Need help with I-130 and I-485

I have quite a few questions here. Here is my story first of all. I submitted I-130 for my wife 2 month ago. At that time I didn`t realize I can submit all the forms needed for her adjustment of status together. Now it looks like it is taking a year or so to get approval.

1. Can I submit I-485 and supporting documents and refer to that I-130 I already sent so they can put them together? If someone on here have done it please share your experience.

2. How long will it take to get approval of I-130? On the USCIS website it states that they are curretly processing July, 30 2007. How long did it take for you and when did you file?

3. I read here on answers that people who submitted their papers concurently went to their biometrics within a month. Does it mean that their I-130 was approved and they were called for biometrics towards I-485? If I was to submit I-130 and I-485 together that would go faster? Why?

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

01/02/2009 EAD received

Hello, I also have done the same thing as you. Here are the answers to yout Q's if you have any more please ask!

1) Yes submit the I-485 and the supporting documents to the chicago lock box, and you may request to join them to the I-130, I did that but that, and it didnt work for me (but I filed the i 130 at LA so that may be the reaseon) But there was another person of this forum, he or she succedded in requesting for them to be joined. So yes do so, it is worth a try, you've got nothing to loose

Just attach a paper explaining in detail.

2) for my i 130 it took quite a while, you can see in my timeline, but again i filed in LA. Dont wait for tht I-130 to be approved, file now. It doesnt matter how long the I 130 takes, the i-485 is what is really important because that will adjust the status, the I-130 wont.

3) It has not affected me what so ever. My timeline with the AOS has been great, I have gotten the biometrics done with everyone else who filed everything concurently. And I received my EAD in a timely manner.

Amty, when you submit your I-485, you should include a copy of the I-130 NOA that you received from USCIS. The I-130 will be adjudicated at the same time as the I-485.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

09/02/08: Received Biometrics Notification

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

2. How long will it take to get approval of I-130? It usually takes about 1 year. On the USCIS website it states that they are curretly processing July, 30 2007. For lack of reliable independent statistics based on a high enough number of cases to predict processing times, the USCIS times are probably the best conservative "guestimate" to guide you. How long did it take for you and when did you file?

3. I read here on answers that people who submitted their papers concurently went to their biometrics within a month. Does it mean that their I-130 was approved and they were called for biometrics towards I-485? No, filing I-130/I-485 concurrently and being called for biometrics does not mean that their I-130 was approved. The I-130/I-485 are usually adjudicated together, at around the same time, likely within USCIS processing times, i.e. within around 1 year. Biometrics are initially done for the EAD and AOS, but this does not mean that the I-130 petition has been approved. If I was to submit I-130 and I-485 together that would go faster? Why? No, it would not go faster, as I said, it usually takes around 1 year, more in some cases, to adjust status from within US based on spouse petition.

hello,VJers. im new here but i already have my membership before. and when i tried again to use my log-in name, it doesnt work anymore. so, i decided to log-on another user name. i have a confusion about my schedule. the NVC already sent me an appointment date through my email and my interview will be November 13, 2009. do i have to wait for the package that USEm manila will send me?
