Hi!

So, when my K3 is issued, I understand that I will be in the US on a visa and will not be a PR until after AOS. But when exactly does my country of residency change? The day I arrive at the Border with my K3? When I get all my stuff moved? Do I have any choice in the actual date? I live very close to the border and my US spouse and I have been visiting back and forth without any difficulty. I may have my K3 within a month or so, but it would be an advantage if I could wait until my current job contract ends later in the summer to actually move to the US and would need to keep my Medical, Drivers License, and other resident items while I would be working - up until I actually pack up my things and move. But, will I be deemed a US resident and unable to keep all these things, if they activate my K3 on my first visit south after its issued..

I am sure this question has come up here before, but my searches have not found anything...

many thanks for any info you can provide

Annie

Your residency changes when you actually move all your stuff and say "I'm living in the US now".

Once you get your K3 and have "activated" it, you can send in the application for EAD and/or AOS, but you can continue to work in Canada until your contract is up (a few people have kept working in Canada until they had EAD for the US). Because a K3 can't get a SSN or driver's license until they have EAD, its best to send in that application as soon as possible. Even if you're staying in Canada thru the summer, it'll take 3 months for your EAD to process anyhow, might as well get started on it asap.
