address change and removing conditons of GC

hi, just a quick question. We recently moved to our new place a couple months ago but have not inform USCIS about the address change yet, now it is time to apply for Petition to remove conditions (I-751) since my wife's Green Card is expiring this August '08. What do I need to do? should I have the address change before I submit I-751 or just put the new address on the form? please feel free to give any additional info, tips you might have to speed up the process. I hope to get the new GC by January of next year for an overseas trip. thank you

Here's what the USCIS website says:

"Customers who have an application and/or petition which has been filed with USCIS but has not yet been decided (also known as a 'pending' case) should notify USCIS of any change of address as soon as possible after moving.

The law requires nearly all non-U.S. Citizens to report a change of address within 10 days of moving by completing a Form AR-11. Abiding by these legal requirements and completing the necessary forms does not update an address on any applications or petitions pending with USCIS. Non-citizens with pending cases must do both.

Most customers can now notify USCIS to change their address on a pending case online here on our website. Non-citizens can also now complete the Form AR-11 online here on our website.

If you choose to change your address online using our Online Change of Address Notification tool, you will need to have some information available. Please have the following information available before you begin:

* Your receipt notice or other notice we sent you showing your receipt number (if you have a pending case with USCIS).

* Your new address

* Your old address

* If you have filed a petition for a family member, please have the names and biographical information for that person.

* When you last entered the United States (if you cannot remember this information please fill in an approximate date)

* Where you last entered the United States (through what port of entry you entered - whether by land, sea or air)

How do I submit my change of address if I don't have my receipt number?

An AR-11 Change of Address does not require a receipt number. You can submit your change of address for a Pending Case if you have not yet received a receipt number for your application.

If you have paid for your application by:

Check: You can update your address using USCIS' Change of Address Online. This requires your receipt number. Look at the back of the cancelled check that was returned to you through your bank. On the back is the 13-digit USCIS receipt number which looks like this (but will have different letters and numbers) ABC 01 23456789 Use your 13-digit number when you are asked to input your receipt number in your change of address.

Money order: You can report your change of address by calling USCIS Customer Service toll-free at 1-800-375-5283, and a USCIS Customer Service agent will enter your new address for you."

That sounds to me like you should fill out the AR-11 now. Then call the USCIS to make sure they got the address update and about having to fill out I-865 (Sponsor's change of address for people who filed out I-864 affidavid of support). You may need to also fill that out.

If you are her sponsor, you'll need to do a snail mail I-865 too for sponsor's change of address. The AR-11 for her you can do online - you'll just get a confirmation number. I'd just do it before I751 and obviously you have to put all your addresses since the marriage on the I751 so if you feel the need to explain you could do it there.

I've seen lots of people on these forums be late with sending in the AR11/I-865 and nobody (to my limited knowledge) has reported a problem from it...

Just put a new address on I-751. Plus, you will need to add a page with an old address and a new one in I-751 package. Read I-751 instructions. You need to inform CIS of address change within 10 days only, I think, if you have pending application.

The sponsor stage is in the past. He is not a sponsor for i-751-both should petition. Since they don't have any pending applications at this time-no need to send change of address form or do it online/phone.

Sponsorship is in force until the petitioner becomes a US Citizen, dies, or completes 40 work quarters.

From the I-864 Affadavit of Support:

'Your obligation to support the immigrant(s) you are sponsoring in this affidavit of support will continue until the sponsored immigrant becomes a U.S. citizen, or can be credited with 40 qualifying quarters of work in the United States.Although 40 qualifying quarters of work (credits) generally equate to ten years of work, in certain cases the work of aspouse or parent adds qualifying quarters. The Social Security Administration can provide information on how to count qualifying quarters (credits) of work.The obligation also ends if you or the sponsored immigrant dies or if the sponsored immigrant ceases to be a lawful permanent resident and departs the United States. Divorce does not end the sponsorship obligation.'

AR-11 is supposed to be submitted within 10 days of any address change, regardless of whether you have an application.

That is interesting. Never thought about it (I know my lawer never submitted I-865 and my girlfriend tryed to enforce sponsorship agreement-went to a few lawers to be told that it is not possible). Back in Russia, we have to get a stamp from local police when we move from place to place. Never thought that here the same situation and that we have to inform CIS about our location even when we don't have any pending applications. So, address change is not for communication purposes but for monitoring too.?
