Criminal History, I864, I485, G325, PLEASE HELLLLP !

Hello,

I'm trying to submit my AOS package and when I called USCIS they told me to contact a lawyer, :S so please help me out here. THanks

1: it says on the I485 to submit a Criminal History: what is that??? and where can I find that? is it mandatory to have that??

2: The form G325 Biometrics is meant for only me? (foreign spouse) or for both of us??? and if its for both of us, so 4 pages per person??

3: Police Clearances: what is that???

4: the I864: we are both students so one of her aunts is going to be sponsor us, which for of the I864 are we supposed to fill, and which one is she supposed to fill ??

K-1 journey, AOS/EAD and ROC in my timeline

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

I'm here as an F1 Student, I'm on status, never been outta status, but now my Student Visa is expired , but on my I94 it says"Duration of Stay" so I entered legally and I'm fine now.

1.- I adjusted from F-1 and I never submitted a Criminal history, that was back in October and I got my GC in April. Anyway, in case the rules changed and you need it, the criminal history is a piece of paper that lists all the crimes that you have been found guilty of and if you have never committed a crime it says that you have a clean record. It can be obtained from the police department in your city. Again, it is not mandatory, it is mandatory just IF you have a criminal history.

2. yes 4 pages per person, both of you.

3. That also I didn't have to submit since I have lived in this same city for the last 8 years.

4. I also needed a co-sponsor and both, my wife and him, filled out the same form I-864.

Well it depends, I was charged for trespassing once and had to go to court, so I had to get a Certificate of Disposition saying the charge was dismissed. You only need to submit Criminal History documents if you ever had a brush with the law.

As for being an F-1 student, if your visa expired and you're not on OPT, technically you are out of status.

As for being an F-1 student, if your visa expired and you're not on OPT, technically you are out of status.

I beg to differ, if his F-1 visa has expired but his I-20 is valid he isn't out of status. If he has an OPT it's even better BUTTT if the F-1 visa has expired and I-20 hasn't been signed for the semester, and there is no OPT, I'm sorry but buddyyyy you are OUT of status.

No that's not right, as a F1 student, if you visa expires it does NOT mean you are out of status, if your I20 is up to date and it says on your I94 D/S (Duration of Stay) and you are taking the minimym of 12 credits fall/spring you are perfectly fine.

IM CURRETLY TAKING CLASSES, AND I'VE NEVER MISS ANY SEMESTER, AND MY I20 IS VALID TIL 2011, SO I GUESS IM FINE :unsure::wacko:

why do I need to renew my visa again? they only give us 3 months of student VISA, there is no way to go home get a 3 months visa then it will expire like crazy,

He says that you have to file for AOS or renew your visa because if you don't do either one of those, you will be falling out of status.

Since you are filing AOS then you are good to go...
