TSC to VSC frustration

Filed March 19th 2007 to TSC

transfered to VSC Feb 1 2008

threatened by VSC of deportation due to filing late (april 2008).

apparently VSC thought we filled 1 year late to them..

went to local USCIS office in Houston. showed the letter and application date.

the woman there sent email to VSC to explain we filed correctly and on time.

sent response to VSC with photocopies of dates of original application via USPS

the woman at the USCIS in houston said they (VSC) will send letter acknowledging mistake.. (right..like that would actually happen, and of course it didn't)

received NOA to submit "good faith" documents.

i'm working on collecting additional stuff for them right now.

I suspect they lost all of my original documents submitted in light of the mistake they made about us filing one year late.

this has dragged on long enough..I'm tired and discouraged.

I'm sick of being punished for their mistakes. :angry:

Wow, what a mess. I hope it gets straightened out soon. No wonder VSC isn't processing all of our new files very fast - they still have cases like yours to clean up. I sure hope they don't lose our file.

Can you go ahead and file for naturalization, or do you want to do that? I know we plan to file for that as soon as we're allowed to so we don't have to deal with 10 year green card requirements if I get a job overseas.

honestly. I'm only staying in the US for a maximun of 10 more years.

I'm working toward leaving the US for my wife's homeland of brazil, or my homeland of Vietnam.

So naturalization may or may not happen...

hell, my naturalization has never been 100% completed to due to the incompetent geniuses that work for the INS now known as USCIS.

I hold a US passport (got first one before turning 18, parents naturalized before I turned 18), filed for a naturalization certificate like 5 years ago...NOTHING has EVER happened.

I've given up on that cause. as long as I can continue to renew my US passport...i'm good.

You might reconsider about ctzship in light of retirement benefits. You are paying taxes here, your spouse too (or dependent on you but will be eligible for pension if married for 10 years..). US pension might be very helpfull in Vietnam..Just a thought.

checked online and over the phone.

the Receipt Number that was on the NOA doesn't exist according to both.

it gets better and better all the time.

my level of frustration is so high I can't even get angry, just laugh.

I know that is not much of a relief, but have you try to contact your representative/congress individuals?

The amount of errors in your case seems countless and STILL counting, that is not forgivable.

Now, that NOA was like a RFE or what exactly states? Sometimes since is just asking for things they won't appear in the system since they are not made due a petition pending.

I know that is not much of a relief, but have you try to contact your representative/congress individuals?

I'm going in for an Infopass today to have my wifes passport stamp to extend YET AGAIN while we wait...

her conditional permanent resident card is approaching 1.5yrs expired. We still have a few days left on her last stamp.

I can only expect more incompetency and hilarity.

Your wife may have to take her biometrics again for the receipt number to show any status. At least thats what our NOA said, status after biometrics or something like that. Hopefully you wont have to pay for biometrics twice though....

K1 Visa

June 15, 2005 - Submited I-129F

June 29, 2005 - Received NOA1

July 09, 2005 - Received NOA2

July 19, 2005 - Package 3

August 18, 2005 - Package 4 with the interview date (october 17, 2005 in Rio)

September 6, 2005 - Medical exam done

October 17, 2005 - Interview date APPROVED!!!

December 2, 2005 - Arrived in the U.S.

December 8, 2005 - MARRIED!!!

AOS

December 23, 2005 Sent completed forms for AOS

Jan 2006 - Checks cashed for AOS

Jan 06, 2006 - Received all 3 NOA's

Feb 16, 2006 - EAD and AP approved

Feb 24th, 2006 - Received AP in the mail

March 18th 2006 - Still no biometrics letter, made infopass

April 11th 2006 EAD Biometrics

April 18th 2006 Received EAD in the mail

May 10th 2006 AOS Biometrics after calling 800 number for 2 months, they claimed letter was returned undeliverable by the post office.

May 25th case transfered to California Service Center

June 5th case received by California Service Center

June 14th - Email that a Greencard was ordered (no interview)

June 17th - Welcome letter comes in the mail

June 19 2006 - Greencard arriives in the mail - WE ARE DONE!!!

Sept 2006 - Passed the road test

October 2006 - First job in U.S.

March 2008 - File I-751 - Biometrics taken

So the latest step in this journey of trials and tribulations.

They just sent a letter requesting an interview in 1 months time.

great.

I have to interrupt work and travel back to my home city to do this interview.

this will be a major hassle as our work obligations will have us on the other side of the country at that time.
