Fiance with a Chile

Hi,

I live in the U.S. and my fiance lives in Chile. He would like to live with me here in America. But he has a child with a past relationship. When he lives here he plans on supporting the child financially and going back to Chile as often as he can. I was wondering if anyone has had this experience in the past? Is it likely that he gets denied because he has a child? Does the childs mother have to sign papers allowing him to go? Any advice is greatly appreciated.

Him having a child will have nothing to do with getting a visa.

If the child comes to live with him, then yes, she may have to sign something allowing it.

Is he the custodial parent? Then the child is eligible for K-2.

If the child is staying with the mother in Chile, then no, your fiance won't need permission from the her to go.

He won't get denied just because he has a child there.

It's possible if he owes child support I guess. Otherwise I can't see how/why a parent who was not the custodian of the child would be prevented from leaving.

Sorry, I originally posted it but had a mispelled word. He doesn't owe any back child support but as the child is under 18, I am assuming he is going to still have to pay child support. And I didn't know if because he is going to owe child support in the future and he is coming to live in America if they can say no, because there may not be any laws here that uphold the Chilean laws..? If that isn't the case and he is able to still get a Fiance Visa with a child, that is one less thing I have to worry about :)

As far as I know, child support can only be enforced in his country.

They won't say no based on that. If he did owe back child support that was filed with a court, it might be an issue.

He still needs to pay, cause it's the right thing to do.
