POE and temporary work visa...

I have heard that the only way to receive temporary work permission is to enter through JFK. Are the chances pretty good of the getting the 90 day work visa, if my fiance enters through JFK?? Have alot of people had problems with that, or been denied the work visa through there? Is it possible to just ask if they don't offer it right away??

We're planning on doing a civil ceremony right after he arrives, so we can get his change of status application in right away, but its a little strange to think he could be sitting here for 3-6 months (or however many months it usually takes for the change of status to be processed) with nothing to do...

What have peoples experiences been like entering through JFK??

The stamp you are talking about is temporary employment authorization, not a work visa. The K1 is a work authorized visa.

If he is not given it automatically chances are he will get if he asks. There are other POE that have given it out in the past though. Others who have gotten it at other POEs can probably shed some light on that.

Don't go through Philadelphia, they definitely don't give the stamp. The immigration guy we talked to said they stopped doing it a while ago. He also told me that JFK is the only POE that he knows is still practicing the temporary work authorization stamp. So your chances are highest at JFK. And yes, you need to ask if they don't offer it to you first (according to our attorney).

I wish I knew before we booked the tickets through Philadelphia, cause sitting around is really not fun.

They will probably issue it if he asks but even if he has it, it will expire in 90 days and he could be left in limbo without any work authorization / or job until he receives the new EAD filed with AOS.

yes, you have a good chance for the temporary work permit.

but it expires in the 90 days of the K1 visa.

but, if you quickly apply for AOS, you might get the 1 year EAD within or close to 90 days.

you have to get married and send in the AOS paperwork right away or as soon as possible to meet that 90 day timeframe.

the actual green card wil take longer, 6 months or more for the green card.

also, since you are paying $1010 for AOS, ask for the Advance Parole letters too.

The EAD and AP are included with the $1010 AOS fee.
