Hi,

We have a bit of concern about about document preparation for AOS... i think i have a way out but i'm sure lots of people dealt with it before and might offer a valuable advice...

Specifically, USCIS requires certified copy of marriage certificate which in our case we need to obtain from Manhattan. Clerks in that office told us that it will take 6-8 weeks to get that copy to me by mail. The wait is unacceptable 'cause it's too close to 90 days deadline. The trip to NYC is too long to take.

So we're thinking about sending the original marriage certificate to USCIS with AOS application. We'd keep a certified copy for my records and use (possibly exchange it with original at the time of AOS interview).

Are there any situations in life that we would need an original marriage certificate? I mean we got SSN and driver licence already so that's out of the way...

Just make a regular photocopy of your marriage certificate. Send the copy with your application and bring the original to your interview. USCIS doesn't require a certified copy, just a regular photocopy.

90 day deadline?

To the best of my knowledge AOS does not have an 90 day deadline

When we filed the AOS it was over 4 months after we were married, and we expect to receive the green card next week or two after a 5.5 month wait :)

So if you want waiting will not be that much of an issue

12/31/07: Sent I-751 packet to Texas, the LONG wait begins once again!

01/03/08: Packed received.

Technically, if you enter the US on a K-1 visa, you are supposed to get married and file for AOS within the 90 days before the visa expires. You would be considered "out-of-status" after the 90 days if you have not filed for AOS, but USCIS usually forgives such over-stays when one is married to a USC. The important thing is to get married within the 90 days and filing for AOS ASAP.

I sent them the original copy when I received it - and I asked for 2 more certified copies from Orlando - the certified copies that I received are EXACTLY the same as the 'original'. So, don't worry about it if you do decide to send the original (certified copies only cost me $2.50 each.) Good Luck
