I'm concerned about the I-129F being approved -- It's not as of yet, as far as I know ... but what do I do if it's approved before my wife's interview date? EEK!!!

You do nothing. No problem at all. Just go forward with the immigrant visa process and ignore your I-129F.

Originally we filed for K3/K4 because of my 5 yr old child. When our I130 was approved NVC assigned two (2) case number and until now I129F still pending but knowing Vermont's history lately doesn't approves I129F and instead petitioners are forced to take CR1. Under CR1 is my child can still go with me?

Oops, no. The child needs their own I-130 for an immigrant visa or to adjust status from a K4. If you didn't file an I-130 for the child along with the one for the spouse, you'll want to go the K3/K4 route.

Hi Kababayan! We're on the same boat. Thats also my concern what If VSC approves my I130 and disregard my I129? I have a 6 yr daughter who I cant leave behind. She doesnt have a separate I130... but we are hoping we can request to expedite once my husband receives his deployment orders. Lets hope for the best! Keep me posted.

If it was me, I would immediately file the I-130 for the child.

If you end up using the K3, then you use the I-130 for the childs AOS, and it is already being processed.

If you are lucky, the USCIS people will be fast enough to catch your child I-130 up with your I-130 before you interview.

In the very worst case, the money spent on the Childs I-130 is wasted because you decide to use the K3, and do AOS in America. Then both I-130 moneys are wasted. but this is worst case, and can be avoided.

Given the cost of AOS in america, it would be reasonable to fly the child back to Philipines for interview instead of doing AOS in america, then only extra cost is extra round trip to Philipines, and you need to visit home anyway :)

Hey guys - I've just sent off my DS-230 packet today -- going full speed ahead with the CR-1 for now ... Last time my I-129F was touched was 5/26 ... so God only knows if that's about to get approved soon ... NVC representative wasn't helpful with what I "should" do ... but she gave me a number for a Visa Office in Washington, D.C. that I have to try to call soon ...

7/31/10 : Biometrics letter received - Appointment date of 8/11/10!

5/13 : AOS Status now "PAID" -- AOS PRIORITY MAILED

5/19 : DS-3032 email accepted & AOS entered in system

5/24 : IV Bill Invoiced and paid online

Ohhh okay, my husband filed for I-130 for me and my child, we received the First Notice of Action (NOA1) with two I130 case number: 1 for the spouse and 1 child. Then likewise, NVC assigned two (2) case number also. Thanks & God bless.

Filiricans - I'm glad that we were approved around the same time ... What I did was to first call NVC and get my case #, and also my IIN - you need the IIN for online payment ... The online payment system works, but it's not "officially" on the website ... I don't have a link for it but you'll get the best information from a thread started by lotofpatience on VJ ... It's called something like "NVC fastest process" ... the newest version is 1.5 ... that will walk you through the process step-by-step .. I did everything that the flowchart told me to do ... It eliminates waiting for the NVC to physically mail you letters and instructions, because you pay everything online and print the required cover letter right off the same website! It's a HUGE timesaver!

In fact, my DS-230 packet arrived at NVC today!

"Your item was delivered at 11:01 AM on May 29, 2008 in PORTSMOUTH, NH 03801 to VISA . The item was signed for by R AUSTIN."

Hopefully we're less than 2 weeks away from "CASE COMPLETE"! Right now I'm at 22 days since NVC received my I-130 ... record pace so far! lol

Congrats to everyone who has finished the NVC process - and thanks, from all of us, to loto who made it all possible for the rest of us to rush through this process!

hi rajee, thanks for your reply. YES!!! my husband paid online today after we called the NVC and IVR says notification has been sent to the Lawyer on May 26, 2008, until now Lawyer didnt receive NVC letter yet (LOL). Im just a little confused here: per NVC's IVR it says they sent the AOS Bill & IV Bill together. We have a lawyer so the latter will be automatically designated as "Agent" thus DS-3032 is not applicable to us. Is it legal to pay both the AOS & IV Bill together? If that is so... after NVC's confirmation re. the payments of both Bills can we possibly download or generates said packet for AOS/I-864 & IV/DS-230 then mail it to NVC? or do we have to wait for NVC's notifications? Thanks
