Timeline

The Lifetime Learning Credit is 20% of tuition. One of the examples given of this is:

- The student took post-high school education or courses to acquire or improve job skills.

From my estimation, my wife's ESL class qualifies for this as she is taking the course to improve her job skills. Anyone else used this credit before?

Timeline

I plan on using it this year; I think the exact purpose of my husband's ESL classes are that - to improve job skills. He spoke well enough to communicate on a conversational basis, but needed the extra ESL classes in order to get a job in his career field.

10/3 - Mailed I-485 and I-765
10/14 - NOA1 for AOS and I-765.
10/22 - I-485 Biometrics NOA received, appt 11/15
10/27 - Touched on both I-485 and I-765.
10/31 - I-765 Biometrics NOA dated 10/24. Appt on 11/29 at 12PM.
11/15 - Biometrics for I-485 and I-765 done on same day.
11/16 & 27 - Case "touched" on bcis.gov.
12/7 - EAD approval by e-mail. Card is on its way. Thank you Lord!!
12/12 - Received EAD.
1/9/06 - Applied for SSN. Received 1/17
3/30 - Got our AOS Interview notice!! Interview date 5/31
5/31/06 - Permanent residency granted! Passport stamped IR6. God is so faithful!

2/2/16 - Mailed in N-400 paperwork

2/10/16 - Received text that N-400 paperwork was received.

2/16/16 - Text that fingerprint appointment has been scheduled.

3/1/16 - Biometrics interview, Naperville, IL

3/11/16 - E-notice that case is in line for an interview

7/8/16 - Text/site updated that Interview date has been assigned

7/14/16 - Received letter dated 7/11 with interview date on 8/11
8/11/16 - Interview, given paper that said passed test but no decision can be made at this time.

10/18/16 - Received text, status online updated to say oath ceremony has been scheduled!!!!

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

I don't believe ESL classes qualify for the credit, the instructions state that it is for undergraduate and graduate level courses. Your college/university will send you a tuition statement (form 1098-T) if you have qualifying tuition.

My husband's school did send us the tuition statement 1098-T, so in this case ESL classes do qualify I'd say.

It probably depends on where you take them; if from a church or similar loc, maybe not; but he's taking them at the local community college.

This IRS website says:

Eligible Education Institution. An eligible educational institution is an college, university, vocational school, or other post-secondary educational institution eligible to participate in a student aid program administered by the Department of Education. It includes virtually all accredited, public, nonprofit, and proprietary (privately owned profit-making) postsecondary institutions. The educational institution should be able to tell you if it is an eligible educational institution.

Under this, I think community colleges qualify.

The community college website stated:

The College will NOT mail the information reports to students who made payments for non credit courses. IRS Notice 98-49 provided that eligible postsecondary institutions were required to mail information reports only to students enrolled in credit courses.

So this particular community college does not mail 1098-T to students taking courses such as ESL. Which of course doesnt' imply they are eligible. They state the requirements as:

Liftetime Learning Tax Credit: Must be enrolled in at least one term, credit or non credit course. Does not have to be half-time. Tuition must have been paid in the tax year that is being filed.

Interesting stuff, so on the safe side the church courses and those held at local high schools may not be eligible but I'll keep digging.

Bitter. I just spoke with the tax office at the community college and they stated that she is not eligible for a 1098-T form to be issued because the courses she took were non-credit.

So under Expenses that Do Not Qualify on the IRS Website:

Sports, games, hobbies, and noncredit courses. Qualified education expenses generally do not include expenses that relate to any course of instruction or other education that involves sports, games or hobbies, or any noncredit course. However, if the course of instruction or other education is part of the student's degree program, these expenses can qualify.
