Darn our luck- I was just asking my wife to borrow her passport so I could copy her I-94, passport page, visa etc. Well, she lost it, probably in a gas station. I filled out a police report here, but of course I don't have much hope of ever seeing it again.

What do as far as getting a replacement "copy" of the K-1 visa (which will be expired by the time the AOS interview comes around), and more importantly the I-94? I have a copy of her photo page of passport, but none of the US visa or I-94 as of yet.

We want to send in everything plus the police report explaining the missing documents to at least receive our notice of action.

We will get a replacement passport from the Brazilian consulate in Miami. (with her new married name or maiden name?).

Anyhow, the passport replacement is easy. The problems are what I listed above (the I-94 copy mostly).

Please give advice, she couldn't have lost these things on a worse day since her 90 days are up next month. I do have her alien registration number however.

that sucks man, does she have any copies of anything when she filed for the visa?

I'm not too versed but I know you can request copies of the record since she didn't come in too long ago, check with her POE

You can get a replacement I-94 by completing form I-102 at the www.uscis.gov site. It costs $320.

I if were you I would make an infopass appointment first and bring the police report (and your wife!) with you. Be sure to bring your marriage certificate and any other IDs your wife may have. Just my thoughts. I'm sure someone who has been through this will post.

I also do not have a passport, and I did not have my I-94, for some complicating reasons. and it has been tough but so far I have gotten by ok, alright this is what you need to do,

File the I-102, http://www.uscis.gov/files/form/i-102.pdf

I filed mine on Nov, 07 2006

and recieved the replacement on Jan, 30 2007

Get a replcement passport copy from the consulate

Now I I dont feel that you should send in the aos without the required info, because you will receive and rfe, and lord forbid, if you dont have the info you need by the time you get the rfe, that will cause troouble.

I am so sorry for what happned. And yoy are right getting the replacement passport is the easy part. Because recieving the I-94 does take longer. May I also add that the uscis operater was surprised as to how quickly i recived my I-94, so file the needed paperwork, and if I were you I would also make an infopass apontment, explaine to the imm. officer that the 90 days will be up, maybe it will get expedited.

I must correct my statement. The three-month period ends this month, not next month!

We were waiting to receive some money to be able to pay the fees. There is no way that we will be able get an infopass appointment before the "drop-dead" date. Don't know exactly what to do, but we were married within the 90 days, that is the important thing.

I also do not have a passport, and I did not have my I-94, for some complicating reasons. and it has been tough but so far I have gotten by ok, alright this is what you need to do,

File the I-102, http://www.uscis.gov/files/form/i-102.pdf

I filed mine on Nov, 07 2006

and recieved the replacement on Jan, 30 2007

Get a replcement passport copy from the consulate

Now I I dont feel that you should send in the aos without the required info, because you will receive and rfe, and lord forbid, if you dont have the info you need by the time you get the rfe, that will cause troouble.

I am so sorry for what happned. And yoy are right getting the replacement passport is the easy part. Because recieving the I-94 does take longer. May I also add that the uscis operater was surprised as to how quickly i recived my I-94, so file the needed paperwork, and if I were you I would also make an infopass apontment, explaine to the imm. officer that the 90 days will be up, maybe it will get expedited.

Hint! Make copies as soon as you get documents in the mail. Plus ! Don't let her carry passport around town!

Applying for a Replacement United States Visa

Lost/stolen U.S. visas cannot be replaced in the United States. For replacement of a visa, you must apply in person at an Embassy or Consulate abroad. When applying for the replacement of a visa, you will need to provide a written account documenting the loss of your passport and visa. Include a copy of the police report.

I'd make a Infopass appointment and see what they have to say!

Updating-

We made an InfoPass appointment and it was very easy to get the first 8 AM appointment the next day! (this morning). The officer said it was very important that we send the AOS paperwork in as soon as possible. I overnighted the package so the receipt can be stamped before the 90-day period. He gave us a copy of the I-102. So, hopefully the passport somehow turns up, otherwise, we will get a new one in a couple of weeks and file for a replacement I-94.

Hi, I am re-opening this topic.

I wanted to clarify that we have the I-94 number, but no copy of the I-94 itself. We have filed for a replacement I-94, but they are processing applications from back in April. Now we are in trouble here because we only have 90 days (ending in September) to resolve this issue. The RFE also asked for a translation of her birth certificate which we inadvertently omitted. What if I were to send the translation, and the for the other evidence (to extend the time, maybe generate another RFE), I provided the number of this I-94, which we have? Additionally AGAIN, I can provide the police report reporting the loss, and explain that there is a four-month processing time. Will I have any luck calling their customer service number to see if they might accept this evidence? What happens if I am unable to provide the information by September because of the snail-paced processing time of the replacement of the I-94?
