Hi! My Japanese fiancee just had her medical check about 2 weeks ago. And I've been trying to get the I-134 things ready. I'm going to get a statement from the bank, I hope this week, and have my boss write a statement of employment. I also have 4 of my most recent check stubs. Is there any other proof I need? I know I should have prepared these things a bit sooner :( Also, I'm $220 dollars short of making the required 125% of the 2008 Poverty Guidelines, which is $17,500. I don't have enough assets to make up the differene, so I'm gonna ask my dad to be a co-sponser. I know he will need to fill out a I-134 also, so does he need the exact same proof of income as me? And would the poverty guidelines he has to follow be for just him, my mom and my fiancee? I apologize for so many questions, but I just want everything to go smoothly. Any help is greatly appriciated.

Hi. Your father must count his dependants (I don't know if there isonly your mom). The same is for the co-sponsor. Paystubs, employment letter, last 3 yrs of income tax for the co-sponsor he needs to attach proof of his citizenship/residency.

In our case we used a co-sponsor and the petitioner only provided a unemployment letter explanation. The petitioner didn't file another I134...

Also, you need notarize the I134.

If you are below the poverty guidelines you will just need to show 3 times the amount you are short. Since you are short by $220, you could qualify if you have $660 in savings (or assets).

Why not just ask your dad for $660 (or a little more to exceed the guidelines)? I have found that getting a co-sponsor can be difficult; people have lots of questions about what it will mean for them financially (and they should!). I would be quicker and no-paper work needed if you deposited $ from your dad into a savings account and left it there until AOS was completed.

I think its safer to file the I-134, but if your dad refuses and you can't find another co-sponsor I would try borrowing $660.

There is a minimum guideline requirement but the actual issue is to convince the Consular officer the intending immigrant will not become a public charge. IMO, the co-sponsor is a more reliable option in most cases.

Household size is, self plus dependants plus any immigrants already sponsored plus the intending immigrant.

I thought it was 5 times the amount you are short? And if I can't get a co-sponser, could i just take out a small loan? What if my dad doesn't have the last 3 years income tax? Do i need my income tax return too?

If you are going to use a co-sponsor the co-sponsor must show strictly the last year of income tax (2007) the other last 2 years (2006 and 2005) will help also, they're optional.

Also if you have your last income tax year you can attach it to the I134 too, if there is not you can attach an explanation letter about why didn't you report past income tax? Also you must attach evidence of unemployment during the missing income tax year (ex. school's records)

Last night I found my income tax return. My mom had it. And also last night, I thought more throughly and realized maybe I do have some assets. I have my pc, tv, digital camera, guitar and amp, and a dvd collection. I'd guess these are worth about $2,175 which is 25% less than what I actually payed for them. Would these things work as assets?

Yes, but only if you sell them and use the cash as an asset.

Now. This really isn't going to work, IMO. What you are trying to do is convince a Consular officer, your relative will not become a pubic charge. What you would be representing is that to meet the absolute minimum required income level, you'd need to sell all your household goods of any value for a total of a little over two thousand dollars. (Actually selling such things for 25% less than you paid for them, even when one day after purchase is tremendously optimistic. 50% or less is probably more like it.

A co-sponsor is a far more reliable way to qualify.
