Hi All,

I am posting an intimate question for someone who wants to remain anonymous for now. I know she appreciates your help.

QUESTION: WILL YOU BE DENIED THE K1 VISA IF WHILE ME AND MY FIANCE WERE DATING WITHIN THE TWO YEARS WE WERE MARRIED BUT SEPARATED FROM OUR EX-SPOUSE. BUT AT THE TIME I FILED FOR THE K1 PETITION WE WERE BOTH DIVORCED? MY FIANCE WAS DIVORCED A MONTH BEFORE AND I WAS FINALLY DIVORCED 4 MONTHS BEFORE I FILED FOR THE K1 PETITION.

ALTHOUGH WE WERE BOTH SEPARATED FROM OUR EX-SPOUSE's WILL THEY DENY US BECAUSE OF THE FACT OUR DIVORCE WAS SO CLOSE TO THE TIME I FILED FOR THE PETITION?

:no: I don't think they'll care. Just that as long both persons are free to marry and have meet in person within the last two years. Since both are divorced, should be ok. But don't just take my word.

I wasn't a K-1 filer, but I had a similar situation. My husband and I met when I was separated from my (now) ex-husband but not yet divorced. My divorce came through 12 days before getting re-married. We were legally free to marry so we did -- we had been waiting long enough for the divorce to go through. I did have to provide a statement as to how we met, and when that was in relationship to our wedding. Since we had been together for a year and a half before getting married, it wasn't a problem.

As long as you are both free to marry, and are prepared to answer questions about timing, you'll be fine. It's a potential red flag but shouldn't be an impediment.

Dating before divorces are final is not grounds for denial but can result in additional scrutiny of the relationship bona fides.

Facts are cheap...knowing how to use them is precious...

Your case is pretty common - no reason for alarm - just be prepared to show proof of relationship. Worst case scenario - they might want both of you to be present at the interview. Good Luck

Especially if the applicant is from a higher fraud country. I would be prepared to answer questions on it.
