Does a denial at POE affect K-1?

Hello everyone.

Thanks for your consideration and time to look at my topic.

I have two simple(?) questions:

1. If I try to enter the U.S. via visa waiever program and am denied of my entry at POE, will it affect negatively on K1 visa? (Am I gonna be in any trouble later on? I have a logical reason why I try to enter the U.S. while the visa is pending: My best friend's wedding and I am the bridesmaid.) I have heard that it won't, but I just want to doublecheck and be extra sure about it.

2. If I am in the U.S. when the case arrives at NVC, will it take longer for them to perform a security check on me because I will be in the U.S?

Well, I think it really depends on what, if anything, they stamp in your passport if you are denied entry. For example, if they stamp your passport indicating you have a 10 year ban on entering the US, then it will certainly cause problems for you with the K1 as you'll need to file a hardship waiver to overcome the ban.

As for NVC and your presence in the US, it will have no bearing whatsoever.

Yea, I hope they are ok people if they are not nice people.

My fiancee has a reservation to fly over to Japan and I have a reservation to fly to the U.S. on the same day. lol The deadline to decide is tomorrow for both of our tickets. So, I think I will discuss it with him and decide. Thanks again for your time to answer my question.

Mmmm. I hope they do not put 10 year ban on my passport.... That would really really be bad....

The answers are 'no' and 'no'...

They wouldn't give you a 10 year ban for being denied entry for fear of intent to immigrate if everything else is in order and you haven't entered illegally or overstayed before. A 10 year ban is for something like being in the U.S. for over a year with an invalid visa. ;)

Being denied entry, they usually take you in a room and ask you a bunch of questions then inform you that they are denying you entry and why. Then they give you paperwork stating all their questions & answers then stamp your passport with something that just says no longer able to enter the U.S. using the VWP then send you on your way. We included a copy with our initial petition but even the officers who denied him entry suggested the K1 route.

What will hold you up after approval is not getting your medical and your packet 3 back to the consulate as it will be mailed to your address abroad.

Ok, so it sounds like the consequence of not being able to get into the country due to luck of evidences showing the tie to the home country is not bad. Cool :thumbs:

As you say, what will hold me up is not being able to receive packet 3 and to start preparing for the interview... I would rather go back to the U.S. with a gold star K1 visa with me :star:

Hi Guys this is Mike from Toronto and first of all............CONGRATULATIONS to you both on passing your interview!!!!! FABULOUS!!!!!! Mine is on the 30th of June(GOD, that's next Monday for heavens sake.......LOL) so doing flip-flops emotionally at 3 in the morning......lol.

Sorry I don't have a profile up yet as I just discovered this amazing site last week but I couldn't help notice your advice on having a denial on your record. Last April, based on my frequency and duration of visits to see Debra was asked to "Withdraw my Application for Admission" at Pearson Airport because at the moment I didn't have documents(utility bills, proof of employment, etc) to prove my intent to return but came back a week later and was given a 6 month B2 Visitors Visa. Then just on May 13th past I was refused a TN work Visa(before I received my interview letter) based on the fact that my 1977 Guelph University degree said "Bachelor of Science" as oppposed to "Bachelor of Computer Science"......lol, can you believe that???

So sorry to be so long winded about asking if you think that these 2 denials spaced more than a year apart will adversely affect my interview. All other extensive documentation as been given to me by my Lawyer and it seems like almost a slam dunk........lol, but just wanted perhaps a more educated opinion about things!!!!

And once again............all the BEST!!!!!!

We have the same withdrawal of application of admission from Toronto Pearson. I asked a CBP officer the last time I was thru and he said it shouldn't affect anything; that the K visa would basically wipe out the Denial.

7/11/2007 - I-130 NO1A Hard Copy

8/13/2007 - Son Drayson born in Sudbury, Ontario.

9/6/2007 - I-129F NO1

10/15/2007 - Trip to Toronto for Dray's Consular Birth Abroad, SS application, and US passport

3/18/2008 - NOA2 for both I-129 and I-130!! No touches or email notifications at all!

4/2/2008 - estimated that NVC received

4/9/2008 - estimated that K-3 was sent from NVC to USEMontreal

4/16/2008 - Received hardcopy from NVC

4/16/2008 - Packet 3 Received

4/24/2008 - Packet 3 Sent to USEMontreal

7/14/2008 Interview in Montreal!!!!

7/17/2008 Visa received

7/18/2008 POE Sault Ste Marie Michigan

8/21/2008 moving day...back to Anchorage, Alaska!

4/20/2009 AOS granted, 10 year Green Card arrives, Social Security # given :)

Hi Nao,

My fiance was in the US when his case went to NVC. He was still here when Packet 3 arrived at his house in Germany. His mom got the mail for him, opened it and told him all the forms inside. We just downloaded the forms from the Frankfurt Consulate. His visa was approved with no problems.

I don't know if it's different for others, but that was our experience.

Lol......actually I read it just 10 mins before my telephone briefing with my Lawyer in San Diego and he just reitterated what you said so perhaps, just PERHAPS.........lmao.......I can get a straight nights sleep tonight without thinking of the bad guys????????????

Anyway I thought perhaps, since I am having my interview before yours I might just give you a heads up on what to expect so you can sleep well too.......lol.
