My fiance just called me from Barbados. The denied his visa because the consulate officer said that he wasn't convinced that we have a bonafide relationship. He questioned why I wasn't with him at the interview. He told them I have to work.

I sent my fiance 1" thick worth of evidence. Phone call receipts, boarding passes, money transfer receipts, pictures, emails, cards, and all of my financial documents. I sent EVERYTHING that they could possibly want or need. The CO said he is not convinced and told my fiance that he is denying it and that I should speak to the USCIS here in the US.

Please help me.....what can I do at this point? I don't understand why they denied him because I sent a lot of evidence and we do have a bona fide relationship. The CO did not give my fiance anything back. What happens next? How can an individual decide our fate?

Please help me....I am so desperate. I do not know what to do next. I am beside myself and sitting here in shock and disbelief.

Panama, the CO only gave my fiancé his passport and form DS 157. No forms or slips. The CO retained our file. Good luck with you this weeken and with your waiver.

I hope the CO emails me back asap so we can determine our course of action.

Thank you for all your responses.

I just talked to the immigration assistant, Monica Maxwell and she said not to worry, it's not the end of the world. I sent Monica a couple of emails after I found out about the denial and told me that she will forward my emails to the CO who interviewed my fiance. She told me to expect a reply directly from the CO this week and he will tell me what else he needs. I asked if our file will be sent back....she said that the CO will retain our file until he gets back whatever he needs from me.

I feel a little better and if a second interview needs to be scheduled, I will be there with my fiance. I will keep you guys posted. Please keep us in your thoughts and prayers.

LISTEN TO ME CAREFULLY. Right now write down everything your ficance told you, write down what every immigration officer told you, have your ficance write down everything that was said, during the interview, write down everything while still fresh in your mind. Who you talked to, what time, the whole 9 yards. Everyname, every stange thing that was said and or done. How the interviewer acted towards your ficance, how he or she acted when pictures of you too's were shown, letters etc.

Im so sorry this happened, but it can be fixed. Please write it all down while still fresh in your mind. Keep all emails from the officer and or the embassy concerning this incident.

I had a incident at the embassy in Paris once when my husband and I were trying to marry, and if I ddi not take notes, and kept emails and etc. my husband and I would not be married now. Trust me on this one.

God is with you on the Baby, its going to be okay.

I told my fiancé to write everything down. I don't delete any emails while we're still on this journey. When did u have to present your written chain of events?

We just want to be together and he wasn't issued a visa cuz CO wasn't convinced due to the duration of our phonecalls eventhough we talk several times a day and text each other hundred times a day and there are tons more evidence my fiancé presented him with. Its unbelievable.

Good luck to you Lucians, although I can't offer much else but solidarity and prayer and echo what others have said. Keep fighting and hopefully this is just a bump in your long and happy life together.

As early as 2006, COs were calling for second interviews (in Colombia -- see the "Consulate & Embassy" forum, or whatever it's called).

My fiancee experienced a "failure to issue" on April 29 in Ecuador. She brought tons of evidence, but the CO was looking for any excuse to not issue the visa. His was "why your U.S. fiance visited for only 5 days at a time or so." (No matter that I made 3 such trips and have a JOB.) I am "required" to attend a "marriage interview" with her (with much difficulty, I was able to schedule this for June 30). The goal, per the 221g (handed to her only in Spanish, thank you U.S. government), is to "prove the validity of the relationship."

On one hand, calling for a second interview with both parties present seems better than a flat denial. On the other hand, the consulate's website SPECIFICALLY states (in the answer to FAQ #8) that "only the applicant will be allowed in the interview." My detailed thoughts on this are in the "Where's your Fiance" thread in the Consulate/Embassy forum.

At least the anecdotal evidence (which should be organized on VJ into a group of threads) is that the second interviews usually pay off with the issuance of a visa, si man. The drawback is this: If the visa is not issued despite the U.S. partner's presence, the only option is to marry in the foreign partner's country, apply for a K-3 and wait even longer than for the K-1, and end up back at the same consulate that denied the K-1.

Annabelle, it's a VERY good sign that the CO kept your fiance's papers. Three different immigration attorneys to whom I spoke about my own situation said this, si man.

It used to be fairly easy to find anecdotal evidence for all the consulates in the Embassy Forum. Once Admin added the Regional Forums, much of the consular information began to gather in those separate regional-specific forums. It's a shame really because the amount of information we used to be able to gather about all the consulates was once available in one place. Now it's scattered about amidst idle regional chit-chat.

Of course the same thing happens now in the K1 and K3 forums with monthly filer threads. Too much good info is lost within all the private VJ clubs.

It was not exactly a exchange of events. It was when my husband and I were trying to get married Via proxy here in Houston, Tx. where proxy marriage is legal, after exhausting all efforts of marriage in Paris and $5000.00 later, anyways, the embassy would not notatize a doc we needed to get the license here in Houston, so he called me told me what was going on, I emailed embassy and the Dept of State. and then the phone calls flew, embassy, DOS and the Supervisor at the embassy all called me at the same time. anyways, the same damn questions were asked to me, but luckily since I work "with" DHS I learned a lot over the years, and learn to write things down ASAP. Anyways, Im sorry Im rambling, my point is Love, you will have it all in writting while fresh in your mind and in his, it could come in so handy later. My incident at the Paris embassy had nothing to do with a visa, but still it had to do with a realationship with me and him and a clerk who did not know his business. We are lucky, we got married, and had a wonderful honeymoon in Paris, now Im trying to bring him here on a k3, and that is just as grueling as the others. Dont be surprised when this is all over with, you may get a call from Embassy stating they made a mistake, I got that phone call from the Immigration Supervisor in Paris.

Good luck Honey. I know Im a K3 filer always screaming at the K1 filers for getting processed faster then us K3, but my heart truly goes out for you, and your going to get thru this, he will be here soon!!!

You know one thing, phone calls is a crock. Not everyone can afford calling cards, and plain old phone calls. And usually the calls are short cause its so expensive to call international.

My phone bill alone is minimum $300.00

But yes, print all records, I cant believe that guy at embassy, what a jerk!!!!! Oh also print out online chats, Yahoo messenger, gmail or hotmail.

I bet your ficance get another interview with a new officer, be there next time if you can, it makes a world of difference.

Now get off computer and get busy young lady!!!! :thumbs:

I am so sorry to hear this happened to u but i have faith and i believe it will all get worked out fast ur in my prayers...........just kind of take strength from everyone on here that knows a great deal about this kind of thing im sure that they are a jack pot full of very valuable information :) in a few weeks u going to look back on this and think wow finally we did it........ :)

My relatives daughter was denied K1 visa at new delhi. reason: She couldn't prove the relationship. there petition was sent back to CSC. He applied for K1 again and his petition was approved and his fiancee was given k1 visa at the same embassy. this time he showed up at the interview.

i-751 filed at CSC

NOA received dated March7, 2008
