Going to Canada in July

So this is probably the dumbest question in the world, but I'm posting it anyway.

My husband (Canadian, but US perm. resident) got his 10-year Green Card in 2006 and now has his Canadian Passport, which was lost for a while. I am a USC with a US passport. Anyway...we are flying to Canada this July for 8 days and for some reason I'm nervous about it (I'm a nervous person).

Once you have your Green Card, you can travel outside the US for 8 days and get back in, right? Even if once like 5 years ago you overstayed?

I know I am probably being way too psycho about this, but I'd appreciate it if anyone could tell me if we are fine or if I need to worry.

Lastly, do I need to bring proof of my ties to the US to get into Canada, even if my husband is a US permanent resident?

8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

I think you have nothing to worry about. He is a permanent resident now, and can travel with his Canadian passport and his GC.

08/31/07 - Réjean makes the big move to the USA

09/22/07 - MARRIED!

10/09/07 - Réjean gets his SSN

Adjustment of status:

10/26/07 - Mailed AOS/EAD/AP

11/23/07 - Biometrics appointment

12/14/07 - I-485 transferred to the California Service Center

12/28/07 - EAD approved!

01/07/08 - EAD received

02/08/08 - GREEN CARD APPROVED!!!!!!

02/16/08 - Green card received!

01/02/09 - Réjean loses his wallet containing his drivers license, Social Security card, and green card

02/04/09 - Our best friends bail us out by giving us the money to file for the replacement green card!

02/12/09 - E-filed I-90 for the replacement green card along with the $370 filing fee (including biometrics)

02/19/09 - NOA1

02/25/09 - Biometrics appointment

05/01/09 - Replacement green card received

Removal of conditions:

01/07/10: Mailed I-751 packet by overnight mail to the CSC

01/11/10: I-751 packet delivered and signed for

01/19/10: Received NOA1

01/28/10: Biometrics (did walk-in due to Réjean being out on the road on original date of 02/10/10)

02/03/10: APPROVED!!!

02/05/10: Received e-mail from USCIS saying the card production has been ordered

02/06/10: Received letter typed on plain paper from USCIS congratulating Réjean on his removal of conditions approval

02/11/10: Green card received

I have been wondering about this, too. So having a Green Card makes it to where you won't be denied re-entry to the USA no matter what?

With immigration stuff you can never say "no matter what" but it is much more difficult for them to deny you entry once you have your permanent residence.

There are limits to how long you can stay outside the country and if you go over then your permanent residence may no longer be valid even if you still have the card.

However, they are not really "in it" to deny a permanent resident access to home and family. It could hypothetically happen.

Going to Canada and give them my Canadian passport, they ask some basic questions, blah blah blah--keep in mind its summer time and Canadian Border patrol dudes tend to hire summer students!! Great place to not have permanent people, just walk right in mr terrorist,lol I actually had a Canadian Border dude tel me i was not able to work in Canada last summer!! What ever kid,lol. Coming back into the USA I hand them my Green card and Canadian passport,and they usually just swipe the greencard and don't even look at my passport!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

"Let back into the US no matter what" only applies to US citizens where they cannot be denied entry. Though very rare, a green card person can be detained and questioned and even denied. In your situation however, that won't be the case.

You can go on the trip without having to worry about anything, just make sure he has the GC and a passport if you are flying and you'll be fine...

Nov - Just recieved Naturalization Interview date for Jan.

Neither of us have criminal records at all and have never done anything illegal, but he did overstay a visit technically due to faulty info from the USCIS 800#!! This overstay did not come up at all in our AOS interview, but I was just so worried it would come up at the airport coming back into the USA because last time he entered the US he came as a visitor and now he has a green card! But...that's the way it goes sometime, I suppose and I guess others have done this, also.

Again, thanks to all for your responses. I will go and not worry about it. If anything crazy happens, I'll let you know. :-)

His overstay was forgiven by virtue of his marriage to you. Proof of that is the green card that he has in his possession. :)
