Ok ...here we go i will try to coherently explain this. first of al i read the guides and did not find what i was looking for. our I-130's and I-129 f were approved April 21, sent to Nvc, Nvc received April 28 and sent to Kiev April 30. Kiev received package May 5. Friday i receive letters from NVC requesdtion $70 for each petition. ( we have 2 wife and step son) on the bottom it says "Status: CR1" for Ekaterina's petition and on ALexci's it says "status CR2" ok....we applied for K-3, almost everything is at Consulate..... do i pay the fee? it seems if i pay the fee this becomes a CR1/CR2 visa. if i don;t pay this will remain I-129f visa (K-3) somebody please set me straight. my only concern at this point is which is the fastest now that Kiev has the I-129f petition.

Only your I-129F is at the Consulate. If you want the K3 and K4 visas instead of CR1 and CR2, just ignore all correspondence in reference to your I-130. You'll notice the two petitions were assigned separate case numbers by NVC.

If you prefer the immigrant visas (CR1 and CR2) then expedite all correspondence regarding them and stall or ignore responses to the Consulate regarding the I-129F.

Thank you this is what my heart was telling me deep down. wanted to confirm. ok since Kiev already has the I-129f and it has been in their hands 2 weeks. This is the fastest route correct? I know the immigrant visa has other perks, green card upon entry, however is there any downside to just letting the I-129f progress?

Letting it progress is the K3/K4 path.

Did you just file both 129 and 130 to just see what would be faster? I never knew you can do it...

And yes, if they had your paperwork in the Embassy by May 5, you could schedule the interview as soon as you knew that? What's you progress on that??

Good luck anyway :) ! You're almost there. I had my interview only a week after my paperwork got into the Embassy. I'm sure you'll be able to have yours soon.

Technically, the petitions racing each other to the visa finish line, was supposed to stop in November, 2006 but sometimes USCIS doesn't follow their own policies. When both petitions get to NVC, the race can be on if you want it to be.

Mariapoe. do you know that we could schedule the interview nce we knew it was there. we were simply waiting for information from the consulate (packet 3 equivalent, apparently Ukraine does'nt have a packet 3 per se) are'nt htere documents in the package she will need to get police reports and medical exam?!!! heck if that is the case we can schedule next week for the closest date. (i am still waiting for my 2007 taxes, on an extension) ptherwise we could schedule immediately?????
