I started the same topic yesterday night, but everything disappeared this morning :unsure: So here's my story again...

I received RFE a while ago for a medical examination. The RFE wording wasn't clear and I didn't understand why would I be asked to do the medical again since I had one done already less than a year ago by that time. So I thought it's asking for a vaccination supplement. My husband called their help line to make sure and the lady on the phone told him that we understood the RFE correctly and all it asks for is the vaccinations supplement. So we sent that. Now I received a letter saying that my AOS is denied since we didn't send in all the requested documents - the medical examination.

So what am I doing next? Please help me :( I was given 30 days to appeal on that decision, but no instructions on how to do so. I have no idea how much that would be effective and what are my other options, if I have any at all... :(

It's so late but I can't go to bed before responding.

First of all please ignore all those fouls, who were writing about deportation.

Nonsense.

I know someone, who married a man and he can't prove he is an American citizen.

He's in his 50s and doesn't have a passport or a birth cert,

So the case has been going on for 7 years.

Especially if you appeal you have all the time in the world.

just do the full medical exam and appeal with it.

I am sure everything will be back on track.

The only bad thing about it is the fact that it delayed everything.

And it's not like I refused to do the medical, it's their help line that told me I don't need to! If I would know that's what they want from me I would give it to them right away.

Unfortunately, calling the help line doesn't work as an excuse to avoid re-doing the medical which is clearly

what the RFE was about. I have no idea why they asked you to re-do the medical, but I'm sure they had

their reasons, and acting in defiance of their request was not a smart thing to do.

If I were you, I'd hire a lawyer NOW. It's a very serious matter -- the appeal is pretty much your last chance

to stay in the country -- if you screw it up like you did the medical, you'd have to LEAVE.

Excuse me who are you to tell

this person : "you'd have to leave" and capitalizing the leave word???

Do you know any examples of people who appealed?

I hope so because your words "if you screw it up..."

are pretty strong.

It's not that bad when you appeal, everything

just gets delayed that's it

so please be human and do not scare anyone.

March 8, 2006 - EAD received

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Feb 28, 2008 - will be sending removal of conditions docs.

This is odd. I got the same RFE and did not know about it for a couple months as my lawyer had it. When I asked them to send me a copy of all the paperwork filed they sent me this Yellow sheet of paper from USCIS also requesting Medical and Vaccination supplement. We went and got the supplement and I sent a letter stating my wife did not need another physical as she arrived on a K-1 visa(which I scanned and sent a copy) and that it was less than a year old. I sent this all in and got a NOA for it and about 3 weeks later we recieved the Letter for My wifes AOS interview which will be March 4th.
