So - my wife entered the US under the Free Visa Waiver after we had applied for her Immigration visa and had recieved NOA1

She left 88 days after she entered.

She is now back in her home country (where we were married and filed) and is preparing for the interview at the NVC.

On the DS-230 form it is again asking for travel dates. Should I put that she was here in the US while her Visa was pending. Will that cause huge problems?

Your thoughts are greatly appreciated.

Thanks -

Applicants can legally enter the US while waiting for the whole visa process to push through. However, she must bring documents showing compelling evidence of her planning to return home. The chances of her being denied at POE by immigration officials is very high if they find out about her immigration plans.

Nobody interviews for a visa at NVC. No visa has been applied for yet so no visa is pending. What is pending is an I-129F petition and an I-130 petition. Once they are approved, she will be given the opportunity to apply for a CR1 or K3 visa.

Always tell the truth at every step and every opportunity during the visa process.
