Hello,

I'm new to this site, just got it while searching, hope you can be of help for me.

I have CR1 interview in US Embassy Lagos in May 14th 2008 and after answering the questions, the CO said that I'm ineligible for the visa because I have applied for B2/B4 visa in 2001 which indicated I'm married. I have never married before it was a mistake on my side, I filled married in the B2/B4 to show strong ties that I will return to my home country and now they are using it as a red flag. The CO said the case will be returned to homeland security where it was approved.

Can anybody tell me what I can do to stop them from sending it back to US.

I need your advice urgently.

12/2006 - 1st visit to naija

12/2006 - Engaged

12/2006 - Got Married

01/2007 - left for US

04/25/2007 - I-130 sent to CSC

04/27/2007 - I-130 received by CSC

05/19/2007 - NOA1 received

06/22/2007 - 2nd visit to Naija

08/13/2007 - APPROVED

08/18/2007 - Hardcopy of the approval received.

08/23/2007 - NVC received

09/04/2007 - Case number assigned

09/24/2007 - AoS bill package received

09/28/2007 - AoS fee sent

10/03/2007 - AoS fee entered into the system

10/29/2007 - I-864 and DS-230 received

11/30/2007 - I-864 and DS-230 sent to NVC

12/03/2007 - NVC received I-864 and DS-230

12/17/2007 - Case Completed by NVC (Hallelujah, Thank You Jesus!!!)

05/14/2008 - Interview date (Thank you, Jesus)

If you indicated you were married and were not then the CO is going to take that as misrepresentation and deny you the visa. From the Classes of Aliens Ineligible to Receive Visas:

© Misrepresentation.-

(i) In general.-Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible.

What exactly did they tell you? Did they give you anything on a piece of paper? Did they say if you could file a waiver?

Getting the petition to stay in Lagos is going to be on the USC. They need to contact the consulate and see exactly what is going on.

You can waive the misrepresentation with a waiver which is a big undertaking. Form 601 has to be filed along with $ 545 and

a letter listing "extreme ' hardship must accompany the form. This letter has to be supported by many documents to prove the hardship.

The hardship has to be on the USC and not you.

Hardships such as financial, family, medical problms etc. the USC has without your presence in the US have to be EXTREME for the waiver to be granted.

I suggest you have a phone consultation with Laurel Scott and then decide how to proceed from there. The waiver must be personally submitted by you at your embassy.

When a waiver is filed it will be forwarded and adjudicated by a USCIS office in Accra, Ghana . Some waivers get approved, some don't. If you chose an attorney, chose the best, be careful some don't know what they are talking about and it is difficult to do without one.

The fees are expensive.

I am currently considering a waiver for misrepresentation which were actually 2 typos in a B2 application.
