Does anyone knows if INS does background checks for I-751? My wife and I got separated after filing joint petition. (We thought we could work it out). I got the house and a car and everything else refinanced on my name. She is moving to another city. I scared. Everything in my life right now, contradicts my i751 package. What do I do? I can’t divorce her, because we have to wait to one year. Does it mean my petition will be denied?

If you are divorcing - you can do the removal of condition on your own (you will need a copy of the divorce decree for it). Its possible that no interview will be held for the removal so you might be Ok on your own. But if your divorce comes through before the removal of conditions happens, then you have to go back to step 1 and redo the removal. What stage are you at right now? Have you filed for removal or is that a year from now? The background check or criminal checks are done to make sure you are 'clean' they donot get into who lives where and with whom. You may have a tough time ahead of you in this process, read up on the forum and do as much research as you can on similar cases . Good Luck
