"Wrong" father in petition

Hey everybody,

the good thing first: my fiancé received our NOA2 in the mail two days ago :D exactly 5 months after we filed in California! And we never received an e-mail from them, our status never changed on their website, we didn't get touched and it still says Case reiceived and pending.

I'm with him in Chicago at the moment and will return home to Germany in June. I hope that things will go rather fast then. There's just one thing that I'm a bit worried about. In the I-129F I put in the wrong dad. I assumed that, by law, my stepdad is my father, because I took on his name and it was changed on my birth certificate, so whenever I had to fill in my birth name somewhere I had to write down his name. As it turns out now, this is not correct, I should have given them my real dad's name instead. How big a problem do you think this is going to be? I was thinking of attaching a note to the packet 3 forms to clarify things.

The father's name on the petition and G325a should match the name on your birth certificate. Sounds like it does. Why do you think that's wrong?

Oh, at this point I would just go forward with the correct name on all forms and be ready to explain the error only if it comes up. It probably won't.

Oh, at this point I would just go forward with the correct name on all forms and be ready to explain the error only if it comes up. It probably won't.

I'm just a bit scared that I'll end up in Frankfurt and it WILL come up and they'll think I lied to them. I'm such a nervous person anyway, I'd die with nervousness!

No, I only mentioned my stepdad in the petition, that's what makes me so nervous.

Its probably more common then you realize for that to happen. If a bio parent has never played much of a part in your life other then conception then its understandable that you would make that oversight.

It was an oversight not a lie. If your stepdad has always been your dad....then to you he is dad.

If it was me I would just tell them that my stepdad has always been dad and it didn't even occur to me to put down my biological father.

Its probably more common then you realize for that to happen. If a bio parent has never played much of a part in your life other then conception then its understandable that you would make that oversight.

It was an oversight not a lie. If your stepdad has always been your dad....then to you he is dad.

That's exactly what I want to tell them, because that's just how it was. I hope they'll be understanding enough to not make a big deal out of it.

But the father on your birth certificate is your biological (birth) father?

If so, sounds to me like it's just a 'quirk' of the way adoptions are handled in Germany. If so the consulate should be familiar with this, and won't have much of a problem with your 'error'.

My stepdad never adopted me, otherwise things would be fine, cause he's be my "legal" dad. On my birth certificate it says my name: Sandy K.

K. is my stepdad's last name. I took it on when my mum got married to him. The certificate says that my parents are my mum and my real dad. It just says that on this and that date I took on the name "K."

It is very complicated, isn't it?

Ah. Sounds rather like the ability to change your name by deed poll in the UK.

Which that consulate (London) asks the visa applicant to show proof of any name changes.

I have no reason to assume that Frankfurt would have different standards.

I can prove that my name was changed, so that shouldn't be a problem. What I'm worrying about is that I gave them a wrong information in the petition.

Hi Sandy,

you will have to fill out more forms for packet 3. You can go on the embassy website of Frankfurt and find all the forms. When you fill those out, just put the data in from your birth certificate and use your birth dad's information. I don't think this will be a problem, because you had to send a birth certificate (copy) to USCIS and they should have found that error, too.

The visa will be issued from the information given in the forms of packet 3, so you should be fine by then.

After you have been assigned your case number in Frankfurt by NVC (FRN...) you also can email to the embassy and explain your problem and ask for advice in what to do. I had very positive experience with them, always answered the emails quickly, gave suggestions, etc. We even got the interview on the date we asked for (so I could be with my fiance).

I just got a note from the consulate in Frankfurt...

Regarding the issue with listing your step father on the G325, we can correct this error on your appointment day, since we have your file here in Frankfurt.

I am SO relieved, I could cry! I was really afraid that it would be a big deal, but it looks like it isn't. Thanks again for your replies (F)

I'll go back home to Germany in 2 weeks (have been here in the States for a visit since early April) and then, hopefully, things will go really fast.
