I am US Citizen and got married on Sep 29 2006 and she arrived October 24 2007. She got her permanent Green Card in US...

We got divorced on Feb 23 2008...

And that anger she left the country and she went back to her home country...

When we divorced in US, she requested to change her last name to be maiden name and changed it... and LEFT...

Suddenly she called me and asked me what she should do to keep her Green Card?

I need help…

1. She changed her last name… (Her green card has my last name – I am the petitioner)

2. She moved back to her country (But she did not report to immigration yet)

What should we do?

Question:

You said she got her "permanent" green card but, it seems like it might really be a 2 year conditional green card since you were only married for a year when she arrived. What is the date it expires? If it is a 2 year conditional green card SHE would have to apply to remove conditions 3 months before it expires - and show proof of a valid relationship and life together for the 2 years. Might be difficult if you two are divorced and she went to live in another country...

Why is it that you say that you are the one who needs help?

Her greencard is valid for another year I guess - till Oct 2009. She can come back to USA and file to remove conditions on her own. Are you still trying to help her? Why?

But yes, she can come back and do it - she will need to show that the marriage was entered into in good faith etc. If she stays out of US for a long period (a year or more) she may not be able to get back in and she will have a hard time proving that she hasn't abandoned her residency. Good Luck

My question what has to be done to come back to US ...

Because her green card has my last name and she is getting a new passport with here maiden name i do not think she can enter US like that...

So what form she has to fill out...

Or anybody know an email address that i can ask Immigration about this issue???

A passport is used to travel in and out of the country and generally the name on the ticket she buys should match the name on the passport. The greencard is used to enter USA - and if it is valid and she hasn't abandoned her residency in the eyes of the Border/Immigration officer - she will be allowed to enter. The names on the greencard doesn't matter as far as matching with the passport or tickets. Understand?

Your ex-wife will have to come back to the US and apply to remove conditions on her greencard. Since you are divorced, she can apply right now for the removal of conditions under a waiver. If she wants to maintain her greencard in good standing, she will need to live permanently in the US with no trips longer than 6 months...anything more is considered as grounds for abandonment. Moreover, she will be eligible to apply for citizenship 5 years after she received her original greencard.

At this point, the name changes are inconsequential...she will just need to provide the documentation that shows the trail of name changes...i.e. changed name because she married, changed name because she divorced and provide the paperwork that reflects those changes.

The passport has her maiden name right now (Because of divorce she has changed it)...

The green card has previous last name (Which is her husband last name)...

And she is in her home country...

Does immigration accept her like that when she tries to enter US?

That is the question????

IF NOT?

What form she needs to send to immigration? What should she do?
