Our EA renewal app and AOS has been filed- does my fiance have to stop working until he gets he gets his renewed EAD? His current place of employment was included in our paperwork. HELP!!!!! PLease advise!

His work does not want him to quit working since they are so pleased with his work. But I do not want to get us or them in trouble if he is not authorized to work. Happily they will take him back, but...... We have gone thourhg so much to get where we are. I hate to risk losing it..

Thanks in advance!! -Shel

You are not renewing his EAD you have applied for a new EAD based on his application for AOS. The Temp EAD given at some POE is only valid for 90 days from the day of entry into the US, it can not be extended or renewed.

His work authorization ends on the 90th day, and he is no longer authorized to work. The employer is the one who could be in trouble if they were inspected by ICE. Any un-authorized work is forgiven for him because he is married to a USC.

shucks that really sucks! how long since you filed the AOS Shell? if he cant get into trouble and the employer wants to keep him then the employer can fix it for him.

Thank you! Now I called the toll-free line for USCIS and talked to a woman (I took her name and associated ID number)and she said that since I ahve filed the paperwork and have the receipt number that that is the equivalent of an extension of the Temp EAD. At this point in time it is up to the employer whether or not to keep him on. Isn't that interesting? What do you think? Thanks in advance! -Shel
