I-864A Proof of shared residency?!

Hi,

I am trying to figure out whether to use a I-864 or I-864A for my sponsor.

I am the non-US citizen, and my fiance is a law school student. We are back living with his parents for the summer so have a shared address as them. His dad is acting as our joint-sponsor as my fiance does not reach the requirements alone. I have a few questions:

1) Does the fact we have only lived with his dad a couple of weeks a factor as to whether we can use the I-864A? And we will not be living with him in a few months time again.

2) What evidence can we use to show residency in the same household? Would bank statements do?

3) If we use the I-864 would USCIS say we need to do the I-864A as we live with the co-sponsor?

Also my fiance did not file tax returns for 2007 as he did not meet the minimum income requirement - is simply stating that in a letter enough? Or do they need proof he is in law school/

I think that the I864A wouldn't be necesary if you aren't going to live permanently with your parents-in law. But if when you file for AOS you put the same address in the forms I afraid that you must use the I864A.

If your fiance doesn't meet the poverty guidelines (125%) he needs to proof the reason about he didn't have income tax reported. He can write an explanation letter about it and attach it with the I864 that he must file too, aside you have a co-sponsor the petitioner must file another I864. Good luck.
