If we are filling out the forms to send to the NVC we obviously have to leave off any information about the kiddo because she isn't due until August.

So what happens after my little demon baby is born? Do we have to file a new petition? I've heard mixed things.

Some people say we have to start the process all over again. *gets gun polished and ready to put myself out of misery*

Some people say we just need to get the baby a passport and that's it. That our baby will be a dual citizen until she is 20 and then she has to decide what country she wants to be a citizen of.

Anyone know?

My thoughts would be depending on the day she has to go back to Japan. If the baby is born in the US, she is an American and there will be no need for any further action. But if you and your wife are in Japan at the time, you could go to the US embassy in Japan and get your child an American birth certificate (because it will most likely be in Japanese) and get a passport for her. (My coworker had to do this in Germany, but it was 5 years ago.)

The baby is automatically an American citizen. All you need to do is find out about dual citizenship in Japan. For example: In Germany a baby born by a German citizen married to an American citizen automatically is both American and German citizen. All the mother has to do is report the birth to the American consulate and apply for an American passport. The baby is already registered in Germany at that point and therefore has both citizenships and can keep them all his or her life.

Of course, if the baby is born in the U.S. then it also is automatically an American citizen. So, all you have to do is google or search for information on dual citizenship Japan-U.S.A.

The second seems less detailed in information. I would call city council close to you and ask about the situation.

I've done a little research on it but not much. Ive been too busy lately reading up on NVC stuff and getting things in order for this new house we are buying, etc etc.

Unfortunately no. She is here visiting right now but leaving in a couple of weeks. Since she is so far along, even if she did get her visa I wouldnt want her to fly back before giving birth because I dont want to harm the baby. Soooo, after she has the baby I want her to wait a couple of months, hopefully during that time she will have her interview and then come back around October or November.

Some babies travel well. Don't sweat it. And if the baby will be nursing, even better.

Japan doesnt allow dual citizenship? That's odd. My friend told me that her son was a dual citizen and had to choose before he was 21. But she is a lot older than me and a lot of things may have changed since she had her kid.

Your baby can travel to the USA on a US passport as a US Citizen. What Japan will or won't allow for the baby is another matter entirely.
