:( i just found out that my Uncle died very unexpectedly this morning and was wondering if there was a way to get home to Canada?...got married 2 weeks ago...am just filling out the forms now for AOS...in which i will apply for EAD ad Advance Parole @ the same time...but was just wondering if there's some sort of "emergency" advance parole???...the USCIS doesn' t have much to say about "emergency travel" except that there are "dire consequences" for doing it without a re-entry permit...

you would think there would be something somewhere that says that if you have a death in the family that you could go home for the funeral?????...get an expedited permit???????

any help is welcomed greatly...thank you in advance (F)

I am very sorry to hear about this. I am also sorry I can't offer any advise on what to do. Not sure if you can get an expedited AP if you haven't filed yet, but hopefully someone will be along that will know. Good luck.

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

Im not too sure of the process, but I know there is emergency advanced parol for this exact situation.

When I had my interview at the London embassy, the consulate officer told me "You cannot leave the US and return once you have entered the US with your K1 visa until you have your greencard or advance parol in hand. However, and heaven forbid, if something should happen to a loved one back home then you can apply for emergency advanced parol, so you are not totally stuck".

Im sure someone will be along with specific instructions on how you would go about doing this.

An uncle is not considered immediate family so you can not get an emergency AP for his death. Sorry, but that's what I have come across before on this forum. If you were so close to him, that you must go then you will be abandoning your visa and will have to start afresh as a K3. Good Luck

thanks...i thought it would be something like that...that's really too bad...i would have like to been there for my parents and my aunt and her family...

Sorry, but this is simply untrue.

Angelyn, make an InfoPass appointment at your local office. Take your completed AOS and AP forms with you, along with your full payment and pics, etc. At my InfoPass they had me run to the post office for a money order because they didn't accept cheques, but I've seen where others have accepted credit cards. You will also require evidence of the death and the upcoming funeral. You can detail everything in a covering letter, also, if you wish. But do this quickly because they need time to draw up the papers.

Now, having said all of this, whether you receive an expedited AP or not is completely dependent upon the officer you get at your InfoPass appointment. Some are very understanding, some are not. It is unfortunate, but a reality. Best of luck, and condolences on the passing of your uncle. (F)

Krikit is right in that you could give it a shot, but if you read on this forum - they do not allow an emergency AP for uncle/Aunt/Foster Parent - only for immediate family. You could get lucky though and they might grant you the AP. Good Luck
