Hi to all!.

Im only new to this site and i know you guys could help me solve of our problem by sharing your knowledge!. My problem is..I came here last 2 months ago as a K-1 VISA, but sad to tell coz our relationship didnt work out well we broke up. And after a month of staying here in the US i found another guy online and we got married last month. We really love each other!.Few weeks after our wedding we found out that i need to go back home in philippines before my K-1 expiration coz K-1 visa is only good for the person who petitioned..IS IT TRUE???it really sucks!!!..

Anyone here knows the same story of me?.Is there any other way for me to stay here in US?...PLS HELP ME about this...and if i need to go back home in philippines what kind of visa we need to file? K-3 or what?..if K-3 what do we need to put in g325a about this form is submitted in connection with an applciation for (here are the choices) NATURALIZATION, STATUS of PERMANENT RESIDENT or OTHER?(if others pls specify)...do i need to check box the OTHERS?and what do i need to specify k-3 visa or I-130?...pls help me about this coz im only new here..GOD BLESS TO ALL

Yes, you will need to leave the USA before your initial 90 days stay has completed. If you do not leave, you could be barred from entering the USA for some period.

There are two spouse visa categories. You can read about them in the "Guides" section here. On the G325a you check the "other" box and write the name of the petition, such as I-130 for CR1 visa or I-129F for K3 visa.

Please take the bolded above very seriously because it is extremely important. You have no option but to leave before the 90 days or risk being barred from entering the USA. K1 is good only if you marry the original petitioner.

Hi hannyperez...thanks for all the adviced!.what you mean that at least i need to leave my last name alone till i come back to philippines and file K1 or K3 vissa?? im still here in Us and next week is my flight going back home but we will send our application now for I-130 and i used my married name is that Ok? pls advise?

Just make sure your previous petitioner whom you didn't marry never reported you or something that will ruin your name to the immigration. Coz that's what hannyperez meant about when there was like this case being told during CFO seminar here in Manila.

hi.

the very same thing happened to a friend of my friend's mom.

she went to the us on a k1 visa. she didnt marry the guy coz, in her words, "i was treated like a yaya and an all-around maid instead of a loving partner" (she's not exactly from a poor family so she couldnt stomach the indignity of what she was being put thru).

while staying in the us, my friend's mom introduced her to a guy friend. the two hit it off, and they got married before the girl's k1 visa expired.

the sad thing is, the girl's original fiance reported her to the uscis, and she was asked to leave the us.

her husband has filed a petition for her (k3). she's been in manila for almost 2 years now, and her petition has yet to be approved.

Oh! I can relate this story for my friend right now, my friend filed K3 visa with other guy ( that's her husband now) but 3 years ago my friend was being applied for K1 visa by another petetioneer but sad to say they broke- off and the petetioner cancelled their papers which my friend havent went to her interview, Now she has a problem with this: that it might had a problem with her K3, any suggestions or advice so I can give it to her....

Would she have a problem regarding this? I tried to help her calling the USManila Embassy and the woman told us that her K1 visa was being cancelled already...

Any advice...

hi ed and sue! sorry this has nothing to do with the topic, but i was just looking at your timeline and IT MAKES ME HAPPY! K3 is being approved really fast at CSC, huh? i'm still at present, a CR1 filer, but thinking of sending the 1-129f this tuesday. but i need a lot of persuading. still have a foggy idea of the stats of the manila embassy timelines in regards to K3.

I-130 Timeline:

5/13 : NOA1

7/21 : NOA2 - APPROVED!!!

NVC Timeline:

7/25 : Case # assigned

9/30 : Case completed!!!! (THANK YOU, LORD!!!)

10/03: Interview date assigned

US Embassy in Manila:

10/30 : Paid Document Verification (just to be on the safe side)

11/12 - 11/13 : Medical at SLEC

11/18: INTERVIEW DATE/MANILA EMBASSY/0630AM - VISA APPROVED!

11/20 : Visa in hand! (that was fast!)

11/30 : Flight to USA!

Life in America:

11/30 : POE:LAX

12/04 : SSN issued - 12/13: card received in the mail

12/04 : "Green Card" issued - 12/13: card received in the mail

NOVEMBER 30, 2010 : CR1 expires

well, i'm hoping to be in the us by june (god willing). so, if things will work out the way we planned, that's about 6 months processing time for k3.

if i were not averse to waiting 2-3 more months (more or less), then the visa could have been cr1.

but 2-3 more months waiting will kill me... so, i've pursuaded my husband to shell out 1k for the adjustment of status :)

hope you're visa processing will be swift and painless

SInce your two application was approved did your husband call the USCIS to continue the k3 and disregard the cr1? Or no need to inform them about that. COngrats coz you got approved early!

hi.

no, my hubby didnt call the uscis nor the nvc

our i-130 is still pending before the nvc but i'm scheduled to be interviewed for the k3 visa next month.

we're playing everything by ear. our main goal is to be together the soonest possible time, never mind if it'll cost us more.
