My wife and I were married a week before our 90 day k-1 visa was expired but we have not filed

for adjustment of status yet (Working my way through the forms now).

-Are we in trouble for not filing the papers before the 90 days were up?

-On the i 485 document what should I put down in the box that asks for "current USCIS status" (what status is my wife in now)?

-If there are no plans to travel in the near future is there any reason to fill out the

I-131 (application to travel) form ......and what about the i765 (work authorization) if work is not planned for this year?

2) She was granted K-1 status and that is what you are adjusting from

3) It is free (other than the cost of passport photos) so why not... Emergency travel by nature is unplanned... you simply never know for sure.

no added cost... it is a form of ID which is huge when trying to get a state ID or DL, get SSN # (if not already).......

You are likely to need to EAD to obtain SSN and therefore Driving license as well.

There might be no plans to work this year but you can change your mind, and that way you have no extra fees to pay. Keep in mind that you can always get stuck in the FBI namecheck or simple have the process be longer than expected. The EAD is a security to allow you to work and do things if needed.

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment

06.26.10: Touched

07.07.10: Card Production Ordered!

07.17.10: Card in the mail :) Done until citizenship

Plus you never know how long it could take to get your green card approved (ie, we filed in Sept and are still waiting due to FBI namechecks). If your spouse gets bored, a part time job could be great to get them to know their community. There's no additional cost and the form is easy to fill out. Just makes sense to do it.

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08
