Waiting for appointment but....we woul like to see each other...

Hey guys Im still waiting the letter from NVC were they ask me to send ds-230 and the photocopy of my passport.

My question is we are planning to see each other in the US and take a trip to anguila. I have to enter immigration in miami to go puerto rico-anguila. This will be for one week and then I will stay for vacations for 3 more weeks. One month in total. Ive had my tourist visa for over 10 years and always went for one or two months a year.

Is there a problem is I want to enter for a month, even if im in middle of my spouse petition visa?

The chances of getting a visitors visa is slim to none, as CBP believes your spouse has immigrant intent. And then, even if you get the visa, there are high chances for a denial at the POE.

Im not going to apply for it, cause I have it. My question is if I can go for one month and come back for my interview.

It is not against the law to use the visitor visa (same was VWP) in the middle of process. But the burden is on you to provide evidence that you do not have the immigration intent with this visit. Basically, you need to prove that you will be returning to your home country and wait out the process. Other people have done it, so it can be done.

THANKS, Im so freaked out about what people say that they can even deport me,,,of course I will have a round trip ticket, in fact Im going to one week to puerto rico I can show that too,thanks

Others who has done it were bringing unexpired lease contract, letter from work, etc that will show evidence of intent to go back to home country.

Some were asked to show evidence, some were not and allowed entry. There are occasions when people got sent back. It depends on the judgement of the immigration officer you are dealing with.
