I don't have the answer, but do see a potential problem. she is still considered to be married to her ex in the Philippines. The Embassy in Hong Kong will attach the K-1 visa in her passport. this is an issue I haven't seen addressed here in VJ.

as far as Philippine Immigration goes, I do not have a definative answer on the problems she might encounter having the K-1 Visa on her passport. CFO, don't see how she could get the sticker which is needed to depart Philippines for USA. could you book separate filghts, so her departure would be from Hong Kong to USA? guess that depends on Philippine Immigration. perhaps you could post this in the Philippines Forum. maybe someone there has had a similar experience or join Mag Anak as has beed suggested, which is a Philippine exclusive Forum.

She got her divorce decree in HK with the consent of her ex-husband, meaning she can't file a divorce in HK without the cooperation of her ex-husband signing some necessary documents in filing a divorce in HK. I don't see any problem if she's planning to go back to visit her children before coming to the US. About the seminar, one of my friend who got her K1 visa in USE-HK went back to the Philippines to visit her family and did not take that seminar but I don't know how much she paid at the airport as tax(?).

I dont know either what's the answer to your question, all i know is that if both parties are Filipino Citizen they are still legally married here in the Philippines.Maybe letting the kids visit their mom to Hongkong will be good, just a thought.

and for your peace of mind, getting her marriage be annuled here in the Philippines is a much better idea so she could visit here as often as she wants to.

if you want information regarding annulment, just pm me.i have a friend that can guarantee an annulment within 8mos.

good luck.
