For some married couples, there may be a way around this by filing head of household.

According the the IRS website, "You may also qualify for head of household status if you, though married, file a separate return, your spouse was not a member of your household during the last six months of the tax year, and you provided more than half the cost of maintaining as your home a household that was the main home for more than one half of your tax year of a qualifying person."

This may be helpful for those whose foriegn spouses are still abroad waiting for their visa.

I was wondering about this myself. Are you automatically excluded if you have a foreign spouse who is not a US Citizen, or is it only foreign spouses without SS#s? My husband and I filed jointly, but he's has an SS# for almost 3 years now. We haven't yet received our payment though, and should have last week.

*Sigh*

*Sigh*

there are quite a few people on VJ who have reported getting their rebate check so me thinks that having a foreign spouse doesn't exclude you.... you do need a SSN though to get the rebate..

Only those whose foreign spouses don't have SSNs yet (and use only the ITIN to file taxes) don't get to enjoy the stimulus package.

As my husband has been serving in the USAF here in England for the last 7 years and we met and married in that time, we won't be getting a dime....I feel kind of bad for him as he won't even be getting his $600 just because he is married to me and I have not yet entered the US....ironically, we were going to use the money to pay for the I-130 we are sending off this month :P
