A friend of mine who used to live in Sahkalin in the Russian far east was married to a woman from there for a number of years. She moved to Houston on a K-1 they got married. They subsequently got divorced.

Anyway another woman who he dated there called him one day in Houston. She had married another guy who worked there and moved back to Houston, bringing with him her and her 3 year old(not his kid). They were married before they got there. Anyway they have started having problems after a few months. He wants a divorce and offered 5K plus 5 months of $500/month support after she left the USA.

Well when her green card comes in the mail he grabs it before she sees it and mails it back stating that he is "terminating her green card". I dont believe he can do this.

I told my friend that she needs to see a lawyer pronto as a hearing has all ready been set in family court(re the divorce). Obviously this guy wants here gone asap.

Does him mailing the green card back mean anything.

The lawyer will make money from this but the result will be the same. The guy offering payment for divorce simply isnt aware of the divorce laws. He will be as it unfolds.

These cases are exactly why there is so many people waiting for there cases to be approved.

He dated this woman for a couple of years, got married and then got transferred back to Houston. he is trying to get rid of his wife at the least cost. Probably once he got home and had a wife who spoke no English and a kid who wasnt his, reality hit. His wife doesnt know much she just wants to stay here. I met her at my buddys house. Her husband wants her out of the USA and gone at the least cost to him. However we shall see what the judge in family court has to say.

His wife has permanent resident status but her green card is "lost" due to the actions of her husband. She needs only to send an I-90, explain the situation, pay the fee and have a new green card sent to her in the mail. She can recover the fee in the divorce settlement. In the meantime, she needs a good divorce attorney.

The USCIS grants permanent residents status, not the husband. I take it this is a 10 year card.

Hmm. I don't see it as cut and clear as that. Yes, her green card is lost, but the circumstances relating to how it became lost could play a role in whether or not her residency is in jeopardy. If he returned the card to USCIS claiming that he wishes for her PR to be rescinded, whether USCIS would pursue this or even further scrutinise any attempt she makes in the future to remove any conditions that might be placed on her residency depends upon what grounds he offered for wanting her gone.

A woman who used to be friends with my wife who is from Brazil came here maybe 10-15 years ago on tourist visas with her two boys. She married some guy building a swimming pool at her friends house.

Anyway this guy wouldnt file paperwork with INS. She moved to a shelter and got some legal help. They ended up all getting green cards and are productive members of society.

I think its pretty sorry someone would drag someone halfway around the planet and then trys to get out of it cheap. I hope the judge socks it to him. Even so if she stays like I told her its going to be tough as she doesnt speak much English and doesnt have good job skills.

Well my buddy talked to his attorney. Mailing back green cards had no effect except she is going to have to get replacements. I guess he and this lady used to date each other when he lived there. so he is putting up the $ for the divorce lawyer. Will see how it turns out.

Well its gets worse. Now the people who have been looking after her mother called and advised she died. I guess she is going out to BCIS and see if she can get some document so she can travel back and take care of it. But her hearing in Harris County family court is in mid June.

Hopefully the USCIS will investigate and decide whether this is marriage fraud or not.
