Hi Everybody,

I got my AOS interview June 26th 2007 and everything was good the officer told us that she can't approve our case till they get the Background check from FBI since then i had a sevral appointment with Infopass but the last time i went there they told me that that FBI background check was done since Jun 11th 2008 and i have to wait for the Final Decision, now it's been over three months and nothing and last week i get a letter with an other Biometric Appointment next week.

So pls How long the Final Decision take? and why another Biometric Appointment?

If anybody need any other imformation let me know pls.

I am guessing you mean your check was completed on Jan 11, 2008. Not sure why another biometrics but could be due to the length of time since your last one, someone will be able to answer this who has had this request.

K-1 journey, AOS/EAD and ROC in my timeline

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

I wish I knew the answer to this too. We were pending FBI name check as well and after numerous calls to the 800 number, they sent a letter saying the name check had cleared within 2 months but the case needed further processing. No idea what they need or anything but we plan to make a infopass appt asap.

I know that if the AOS process takes a lot of time (usually over a year) they require another Biometrics. But the fact that they said they finished your check three months ago and still haven't given an approval is not good. :( I know sometimes they go on to do more security checks in rare cases, which drags the process on much longer.

Call USCIS again to confirm that your name check is complete. Get the name of the person on the line, note the date and time you called. Then I would make an infopass appointment and bring with you the following document: "Memorandum regarding Revised National Security Adjudication and Reporting Requirements issued by USCIS as of February 4, 2008." (It will come up on a Google search; the doc is too big to attach here :angry:)

It states: "...(if) the application is otherwise approvable and the FBI name check request has been pending for more than 180 days, the adjudicator shall approve the adjustment of status application."

If Infopass doesn't work, then it is time to contact your congressman to push the approval forward. Be proactive about this! Good luck! :thumbs:

Thank you so much and yes i mean the check is done and i asked about why i should have another Biometric they said that cuz the first one was expired, how the Biometric gonna expire that's crazy.

Most of the time you can't know your right (Immigration LAW) and you can't also do anythink to help your self out exactly with USCIS and we have just to wait and keep your self and mind GOD Help us.

I know what you means there is always something in the process to make you crazy lol. Hopefully once you do your next biometrics then they will approve your application quickly. Here is hoping for you, best of luck.

The check is done which's mean they have just to review my case and approved but i don't understand why all that!!!? I already contact the Gongressman and they told him the same Sh.... ( my case under review ) so since i don't have another option i think i have to contact the Gongressman again and hopefuly it work this time.
